Why are you proposing this? What are the desired outcomes? |
Live in Care Services are currently purchased via the Local Authority’s Home-Based Support Approved Provider List (HSB APL). These contracting arrangements are not fit for purpose due to the following issues: · Specification within the HBS APL is limited with an unclear definition of LIC. · APL hourly costings vary considerably. Many providers submitted high generic hourly rates meaning the Authority pays more than needed for some packages. · APL rates are based on the traditional home care model of urban, rural and super rural including travel costs which would not be relevant for this service. Meaning the Authority pays more for some packages. · Where examples of poor practice have been identified, there is limited ability to challenge due to the limitations of the current service specification.
Legal and Procurement advice has determined that changing the current HBS APL documentation would present a fundamental change to the way the APL currently operates and therefore we are unable to undertake a variation to contract due to risk of challenge in accordance with Procurement regulations.
It has been determined that the only option would be to reprocure Live in Care Services and the most suitable contracting route would be a Framework Agreement with a small number of high quality, established Live in Care Providers who are able to deliver the service to the desired specification within the agreed pricing model.

There are no known inequalities or negative impacts related to procurement of a framework agreement for Live in Care Services (the proposal). The proposal seeks to equitably benefit people in North Yorkshire where a Live in Care Service is determined to meet a person’s care and support needs. |

There will be no significant affect on how organisations operate. Whilst Live in Care Providers have been able to apply to the Approved Provider List, this opportunity will be available for all organisations to apply. Whilst the Live in Care Providers on the APL may support people with protected characteristics, any existing arrangements will be maintained under the current terms of the Approved Provider List, therefore there will be no impact to those people.
