Selby and Ainsty Area Planning Committee – 11th June 2025

 

AGENDA ITEM 4: ZG2023/1356/OUTM- Outline application for residential development of up to 110 dwellings, landscaping, open space and associated infrastructure with all matters reserved other than access into the site, at land off Snowdrop Rise, Hambleton on behalf of Taylor Wimpey strategic land.

Notes/Corrections/additions

Parag 10.18

Reference to release of safeguarded land is incorrect –(cut and paste from another report). Take out second sentence entirely -

“ The site is in a sustainable location (on the edge of a Designated Service Village) and given that Paragraph11d is engaged, as a result of the housing land supply position, development on the site is considered acceptable.”

Parag 10.47 and Para 10. 48

These refer to appeal decisions at Appendices C & D. These have not been attached to this report.  This is a typing error.  As these were attached to other committee reports brought before members in April it was not the officer’s intention to attach them again here. The intention was to refer to the key findings in the appeal decision within the report. These have been mentioned within paras 10.47 and 10.48. As such, it is not considered that the omission of the appeal decisions in full as appendices has prejudiced any interests.

Parag 10.129

Last box- Affordable Housing should be amended as follows (changes in italics);

10% of the total number of dwellings to be affordable, with a tenure split of 65% affordable rent and 35% shared ownership and/or Intermediate Tenure. An affordable Housing Plan to be submitted at reserved matters to include the type, size, location and tenure type.

Para 10.129

Additional row within the box to note that the S106 should contain a mechanism to avoid double counting of contributions by CIL.

Within the submission of reserved matters, a finalised Biodiversity Net Gain Assessment shall be submitted, showing how the applicant would deliver net gain in accordance with Local Plan policy NE3 (i.e. delivering a 10% uplift) and a Landscape and  Ecology Management Plan. This would be an update of the Biodiversity Gain Assessment prepared by BSG Ecology in December 2023 and the updated calculation submitted in November 2024, based on a finalised layout.

Reason: In order to prevent harm to protected species and ensure net gain for biodiversity in pursuance of Policy SP18 of the Core Strategy.

Current condition 9 be amended as follows;

With the submission of Reserved Matters, a finalised Biodiversity Net Gain Assessment, based on the finalised layout, showing how the scheme shall deliver 10% net gain shall be submitted for the written approval of the Local Planning Authority to update the Biodiversity Gain Assessment prepared by BSC Ecology in December 2023 and the updated calculation submitted November 2024 including a finalised calculation using the Biodiversity Metric.

The development shall be carried out and thereafter managed in accordance with the approved details.

Reason: In order to prevent harm to protected species and ensure net gain for biodiversity in pursuance of Policy SP18 of the Core Strategy.

Additional condition to be inserted to follow the above

Within the submission of reserved matters, a Landscape and Ecology Management Plan (LEMP) shall be submitted to provide details of both Biodiversity Net Gain and any additional ecological mitigation mitigation/compensation/enhancement measures referred to in the BSC Ecology in December 2023 and explain how new habitats would be established and managed. It should include;

·           specifications for tree, shrub and hedgerow planting and seed mixtures

·           and details of the type and location of other ecological enhancements

·           a calendar of management operations and any monitoring considered necessary to ensure delivery of BNG

The development shall be carried out and thereafter managed in accordance with the approved details.

Reason: In accordance with Policies SP18 and SP19 of the Core Strategy.

 

Minerals Safeguarding

Response received which concludes that;

 A minerals assessment has been submitted in relation to the scheme and it is considered that the proposed development is in compliance with the Minerals and Waste Joint Plan S02 in regard to iv) as the location of the proposed development is not considered viable for minerals extraction due to the proximity of residential properties to the south and west of the site.

YORKSHIRE WATER

At the time of writing this update- no comments have been received. Therefore, 

It is advised that the recommendation in the report be amended as follows;

RECOMMENDATION

Members are minded to grant planning permission subject to confirmation from Yorkshire Water that there are no objections to the proposal and subject to the conditions detailed in the committee report and as amended in the committee update and subject to any new agreed conditions proposed by Yorkshire Water and prior completion of a Section 106 agreement to secure the matters detailed in the committee report, with the decision being delegated to the Head of Development Management.
