Proposed Changes to the Constitution

 

Report of the Assistant Chief Executive Legal and Democratic Services

 

 

1.0

 

PURPOSE OF REPORT

  

1.1

 

 

To enable Council to approve the proposed Changes to the Constitution as recommended to Council by the Executive at their meeting on 21 October 2025.

 

 

2.0       BACKGROUND

 

2.1       On 21 October 2025, the Executive considered the appended report ‘Proposed Changes to the Constitution’ and recommended it to Council for approval at their meeting 12 November 2025.

 

2.2       The Constitution is maintained by the Assistant Chief Executive Legal and Democratic Services and kept under review on an ongoing basis. Proposed changes to the Constitution are considered by the Members’ Working Group on the Constitution and the Executive and ultimately approved by full Council.

 

2.3       The proposed amendments to the Constitution include:

 

·         amending the Council’s Petitions Scheme and the management of parking petitions

·         consideration of key implications as part of motions

·         clarification of deadline for submission of Motions on Notice for Full Council

·         clarification of timing of reserve date of February full Council meeting

·         management of points of order

·         movement of the Council Plan agenda item to the May AGM

·         clarification of the process for a Councillor to call an extraordinary meeting of full Council

·         updates to the protocol on audio-visual recording and photography at meetings

·         reimbursing or paying officers’ legal fees and costs when they are involved in legal proceedings arising through the course of their employment

·         updates to procurement and contract procedure rules

·         consequential amendments by the Assistant Chief Executive Legal and Democratic Services under his delegated powers.
