Review of Fees and Charges 2026/27 for Highways and Infrastructure

1.0 PURPOSE OF REPORT
1.1 To seek approval from the Corporate Director of Environment, in consultation with the Executive Member for Highways and Transportation, to increase fees and charges for the financial year 2026/27, in line with the Corporate Fees and Charges Strategy.
2.0 BACKGROUND
2.1 Highways and Infrastructure fees and charges were reviewed in 2025 and following a report to the Environment Corporate Director and Environment Executive Member, were increased in line with inflation, or by a greater amount where costs had increased further, for the 2026/27 financial year.
2.2 The Council’s fees and charges policy agreed in November 2022 provides the framework for fees and charges to be reviewed and updated on an annual basis.
2.3 This report seeks approval for a 3.4% increase in fees and charges from 01 April 2026, on fees and charges where a non-statutory charge can be made. This covers the majority of chargeable services.
2.4 The report also seeks approval for the introduction of increased fees and charges for a small number of other chargeable services related to Traffic Regulation Orders (TROs) and the introduction of new charges for carrying out a search of the Street Works Register on behalf of a customer.
2.5 A full summary of fees and charges for 2026/27 is set out in Appendix A of this report.
2.6 For completeness, fees and charges for Highways and Transportation, Parks and Countryside Services are in-scope for this review. Although Parking Services also forms part of the Highways and Infrastructure Service Unit, parking charges are a separate matter and so remain outside the scope of this report.
3.0 METHODOLOGY
3.1 As in previous years, fees and charges have been reviewed in line with the Corporate Fees and Charges Strategy and all fees and charges set out in Appendix A have had a minimum flat rate 3.4% uplift to account for the effects of inflation and pay award projections, unless a greater increase was necessary, eg due to higher industry or input costs. A small number of fees have been rounded to either assist with cash handling; or where fees are calculated per metre, but a minimum charge applies. A limited number of markets and games in parks fees have been discontinued and are referenced in Appendix A.
3.2 It is proposed to introduce a new charge for the supply of information relating to street works is held within the Street Works Register. This is publicly available for inspection. Where a customer requests that the Council undertakes a search of the Street Works Register on their behalf, this will be treated as an Environmental Information Request under the Environmental Information Regulations 2004. In line with the Regulations, the Council may charge a reasonable fee to cover the costs of searching for, retrieving and collating the requested information. Any applicable charge will be confirmed in advance, and work will not commence until the requester has agreed to the fee. It is proposed that a charge of £55.87 per hour is introduced for undertaking this activity.
3.3 Fees associated with Section 50 and Section 171 Licences have been reviewed and benchmarked against other local highway authorities. As a result, the fee for a Temporary excavation in the Highway (s171 HA) and licence to place and maintain/repair apparatus in the Highway (s50 NRSWA) (including and application and inspection) has increased to £900 (including the statutory inspection fee of £150). An application without inspections will now be £750.
3.4 A further review of fees and charges associated with Temporary Traffic Regulation orders (TTROs) has been carried out against charges from other local highway authorities. Following this review, fees have been increased from £650 to £1200 (plus advertising costs) for 18 month TTROs and £500 to £900 for emergency, five day and temporary event TTROs.
4.0 ALTERNATIVE OPTIONS CONSIDERED
4.1 The Corporate Fees and Charges Strategy requires full cost recovery, which for 2026/27, has been set at a minimum 3.4% uplift. Where a different approach is proposed, it is set out separately in this report and its Appendix A.
5.0 FINANCIAL IMPLICATIONS
5.1 The Corporate Fees and Charges Strategy establishes a requirement to review fees and charges within Directorates on an annual basis, in order to help raise income and lower the burden to Council Taxpayers and ensure that the fee charged for a council service is reflective of the council’s costs of provision.
5.2 The proposed schedule attached as Appendix A does not include all Highways and Infrastructure fees and charges. For areas of the service that have been the subject of more significant cost increases, eg the NYC Permit scheme, detailed cost exercises are currently being carried out to establish the true cost of provision, to ensure fees and charges are set at the right level. The outputs from these more detailed reviews will be presented to a separate Environment Executive Member meeting.
5.3 More generally, this report proposes that Highways and Infrastructure fees and charges estimated income will increase as a result of the proposed prices in Appendix A, which in the main, are due to applied inflation since the previous fee review.
5.4 It is estimated that the increases above inflation, linked to TTROs and S50/S171 works alongside the introduction of the street works register charge will increase income by £412K per annum compared to 2025/26. This income has been identified within the Medium-Term Financial strategy as savings proposals
6.0 LEGAL IMPLICATIONS
6.1 The methodology adopted for increasing fees and charges is consistent with the Corporate Fees and Charges Strategy, which indicated that the Fees and Charging Policy applies to services where there is a legal power to charge for the service and discretionary services.
6.2 Section 93 of the Local Government Act 2003 and Section 3 of the Localism Act 2011 give local authorities power to charge for discretionary services. Discretionary services are those services that a local authority is not required to provide but may do so voluntarily.
6.3 The charging powers do not apply where there is a power to charge for a particular service elsewhere in other legislation, or where other legislation expressly excludes an authority from charging.
7.0 EQUALITIES IMPLICATIONS
7.1 No equalities implications are considered to arise as a result of the proposed changes to the fees and charges set out in Appendix A. Any increase is reflective of the cost of delivering the service and/or in line with the Consumer Price Index inflation rate. All the rates have previously been benchmarked against comparator authorities. An Equalities Impact Assessment screening form has been completed, which is attached as Appendix B.
8.0 CLIMATE CHANGE IMPLICATIONS
8.1 No climate change impact is considered to arise as a result of the proposed fees and charges, see Appendix C for further details.
9.0 REASONS FOR RECOMMENDATIONS
9.1 To ensure that the fee charged for a council service is reflective of the Council’s costs of provision.

i. a 3.4% increase in appropriate fees and charges as outlined in Appendix A ii. introduction of a new charge for Streetworks register searches iii. increase in charges for Section 50 and Section 171 Licences and the processing of Temporary Traffic Regulation Orders. |

The purpose of this assessment is to help us understand the likely impacts of our decisions on the environment of North Yorkshire and on our aspiration to achieve net carbon neutrality by 2030, or as close to that date as possible.
