Report of the Assistant Chief Executive Legal and Democratic Services

1.0	PURPOSE OF REPORT
1.1	To enable appointments to Committees and Outside Bodies to be considered.

2.0       APPOINTMENTS TO NORTH YORKSHIRE COUNCIL COMMITTEES

2.1 Pension Board

Re appointment for four years of Emma Barbery (Askham Bryan College) as an Employer Representative.

Re appointment for four years of Simon Purcell (Unison) as a Scheme Member Representative.

2.2       Pension Fund Committee

Appointment of Neil Braham (Unison) to one of the Union Representative vacancies on the Pension Fund Committee.

2.3       Health and Wellbeing Board

Integrated Care Board appointments:

· Removed – Amanda Bloor (Chief Operating Officer, NHS Humber and North Yorkshire Integrated Care Board)

· Removed – Mark Bradley (North Yorkshire Place Director, Humber & North Yorkshire Health & Care Partnership)

· Added – Lisa Pope (Deputy Place Director, NHS Humber and North Yorkshire Integrated Care Board).

2.4       Statutory Licensing Committee

            There remains a vacant North Yorkshire Independent seat on the Statutory Licensing Committee.

3.0 YORK AND NORTH YORKSHIRE COMBINED AUTHORITY COMMITTEE PLACES COMMITTEE AND OUTSIDE BODY APPOINTMENTS 2026-27

3.2       Changes in political proportionality over the course of 2025-26 at City of York Council and North Yorkshire Council mean that some of the seats need to be reallocated.  The changes that result from the application of political proportionality by the York and North Yorkshire Combined Authority are as follows:

Audit and Governance Committee

The Conservative Party lose a seat and this is reallocated to Reform UK.

3.3       Please note that the political proportionality calculation undertaken by the York and North Yorkshire Combined Authority is based upon political parties and not political groups.

4.0       APPOINTMENT TO BODIES LISTED IN SECTION 1 OF THE LOCAL GOVERNMENT AND HOUSING ACT 1989

4.1       The requirement of political proportionality applies to appointments to bodies listed in schedule 1 to the Local Government and Housing Act 1989. Such bodies include ordinary committees and sub-committees of the Council. Where political balance requirements apply, the Council can only depart from these rules by passing a resolution with no member voting against the resolution known as “nem con”. Notice of the proposal to pass such a resolution must be given to every member of the Council in the same way as Council is summonsed.

4.2       It is proposed that Council approve that membership of the Hearings Panel, being a sub-committee of the Standards and Governance Committee and also the General Licensing Sub-Committee be appointed or constituted without regard to political proportionality. These sub-committees need to be able to meet in a timely manner and are quasi-judicial panels. Members who sit on these bodies must have received full training on the processes before them.

5.0       IMPLICATIONS

5.1       There are no equalities, finance, legal or climate change implications arising from the recommendations in this report.

6.0       REASONS FOR RECOMMENDATIONS

6.1       The appointments are to be made by Council as per the Council’s Constitution.

7.0	Recommendation
7.1	That the Council confirms the appointments to current vacancies on the committees, as per sections 2.0 and 3.0 of the report, and the process for the appointment of the Hearings Panel and General Licensing Sub-Committee, as at section 4.0 of the report.
