Approval that the Authority refer the opposed Diversion Order to the Secretary of State for resolution and to support the confirmation of the Order in its submission to the Secretary of State (SoS).

It was considered that the reasons for the proposed diversion of the bridleway met the relevant criteria, and if the Order was successful the new route would not be substantially inconvenient to the legitimate users of the route. It was considered that the applicant had acted responsibly in attempting to divert the public away from the area of the property where agricultural vehicle movements could pose a danger to the public. Only two objections to the Order had been received and the Order was otherwise supported by local user groups and the Parish Council

The other options available were to decline to refer the Order to the Secretary of State, or to refer it to the Secretary of State not supporting the confirmation of the Order. Neither option seemed appropriate given that the criteria for making the Order was met, and that the Order was supported by the local user groups and the Parish Council.
