This Definitive Map Modification Order remains opposed therefore it must be referred to the Secretary of State. It has been decided that the Authority will take a neutral stance towards the confirmation of the Modification Order within its submission to the Secretary of State.


Reasons for the decision:

The YDNPA investigated and sealed this Order but no longer have responsibility to progress the Order. YDNPA do not wish to contribute further to the processing of the Order. NYCC is not entirely satisfied that the evidence submitted in support of the application and the evidence subsequently uncovered by YDNPA, is clear enough, or is sufficient, to outweigh the initial presumption that the Definitive Map is correct in recording paths 05.70/39 and 05.71/3 as bridleways.

Alternative options considered:

The only alternative options available were either to support the confirmation of the Order or to oppose the confirmation of the Order within the submission to the Secretary of State. However, it was considered that the evidence was not sufficiently clear for either of these approaches to be taken.
