Decision:

To agree an uplift of 1% for fee levels in 2015-16

Specifically the standard fee levels for care homes within North Yorkshire will be:

Residential £475.93 a week
Nursing £426.30 a week (plus Funded Nursing Care)

1% uplift to those providers not covered by full life of contract costs
For out of county placements we honour an uplift agreed by the host authority where they have undertaken an Actual Cost of Care exercise, and will consider individual business cases where there is no Actual Cost of Care exercise in place

The Care Act requires Local Authorities to ensure a Sustainable market for care and support. Care Act Guidance makes it clear that councils must take account of costs in setting fee levels.

The uplift of 1% reflects inflationary costs based on the formula agreed as part of the settlement of the Judicial Review received in 2012. The formula uses data from nationally produced indices of wage levels and prices.

The result of consultation undertaken with providers indicates that 58% of providers agree with the proposed increase.

Alternative options considered:


The settlement of the Judicial Review set out the commitment ot increase care home fees in line with the formula, so no alternative was considered for these contracts.
For other contracts the other options considered were
• Pay no uplift given the budgetary considerations of the Directorate.
• Use a similar process to that of 2013/14 and ask providers to indicate by means of financial information the justification for uplift.

These were rejected on the basis they would
• Not take account of the responsibility to ensure sustainability of the market
• Would likely to lead to significant numbers of individual requests which would be onerous to administer for both providers and the council
