North Yorkshire Council must designate a
neighbourhood area if it receives a valid application and some or
all of the area has not yet been designated (Section 38A of the
Planning and Compulsory Purchase Act 2004).
Tockwith with Wilstrop Parish Council submitted an application to
North Yorkshire Council to designate the Parish Council area as a
Neighbourhood Area. As per the regulations, the Council is required
to designate the neighbourhood area without consultation as it
relates to the whole of a single parish.
Whilst no decision is required of Executive Member or Officer, the
application to designate the area is being identified for entry on
the Forward Plan as there is more than one community/village within
the proposed (Parish Council) area. As such, it has been placed on
the forward plan for transparency and openness.
The Executive Member for Open to Business
approved the designation of the Tockwith with Wilstrop as a
neighbourhood area under Part 2(7) of the Neighbourhood Planning
(General) Regulations 2012 (as amended), to enable the next stages
of the development of a neighbourhood plan to commence.
As the neighbourhood area application was for
the whole of a single parish there was no requirement for public
consultation. There are no reasons that indicate that the area
should not be designated. Therefore, the recommendation is the
neighbourhood area is designated.
