The local highways office wishes to gain entry
to the garden of ‘Poplar Villa’, 169 Falsgrave Road, to
carry out ground investigation works. The Assistant Chief Executive
(Legal and Democratic Services) to issue a Notice to the of owner /
occupier under s289 of the Highways Act 1980 to allow the Highway
Authority to carry out its statutory functions with regard to the
construction, alteration, improvement and maintenance of the
highway.

The local highways office wishes to gain entry to the garden of
‘Poplar Villa’, 169 Falsgrave Road, to carry out ground
investigation works. We require to do this so as to be able to
accurately design and cost a retaining wall which is a necessary
component of one of the options (‘Option Poplar’) being
investigated to allow a junction improvement (new traffic signals)
at A170 Stepney Road, Scalby Road and Falsgrave Road, Scarborough,
also known as ‘Crown Tavern junction’.

Landowner has refused access to for ground investigation.
