The Opposed Diversion Order be referred to the
Secretary of State (SoS) for resolution, and in its submission to
the Secretary of State the Authority takes a stance of supporting
the confirmation of the Order
It was acknowledged that the points raised by
the sole objector to the proposed diversion of the footpath were
insufficient grounds to justify the abandonment of the Order
process
The alternative option was to abandon the
Order, and not refer the matter to the SoS for resolution. This was
considered inappropriate as the applicant’s reasons for
requesting the diversion of the footpath meet the relevant
criteria, including that the proposed route is not substantially
less convenient to the public
