Decision:

North Yorkshire Council intends to enter an agreement with the Woodland trust for the dedication of approximately 400m2 area of land below Snaizeholme Retaining Wall, Hawes for highway purposes pursuant to section 72 of the Highways Act 1980. The land is to be used to form an embankment to replace the existing retaining wall which has partially failed.

Reasons for the decision:

Formation of an embankment will prevent ongoing maintenance/repair costs and stabilise the full extent of the retaining wall. It is considered that the construction period for an embankment would be similar or shorter than a take down and rebuild of the failed section of wall. Additionally, formation of the embankment can be undertaken whilst the highway remains open to traffic.

A partial collapse occurred in December 2022 and a temporary repair was carried out using bulk bags to retain the area. A permanent repair is needed for this section, but some of the remaining wall is poor and urgently requires work to be carried out.

Alternative options considered:

Rebuild of the failed section of the wall was considered, however this option would incur long-term maintenance costs, particularly if other areas of the wall fail.
