Re: C8/2020/1338/CPO – Planning
application for replacement and upgrade of local infrastructure to
reduce impact from local sewage flooding. The application includes
a fenced compound to enclose site, four weatherproof plant
enclosures on raised concrete slabs, a vent stack, new access track
from highway on land at Yorkshire Water Sewage Pumping Station,
Main Street, Colton, Tadcaster. LS24 8EP on behalf of Yorkshire

The Chief Executive Officer has taken all relevant information into
account in exercising his emergency delegated powers in this matter
include considering the views of the Planning and Regulatory
Functions Committee held on 3rd August 2021 and agreed the
following:
That the application be approved for the reasons stated below and
in accordance with the conditions outlined in the report, subject
to the following amendments:-
Para 7.9 under location
CORRECTION: Paragraph 82 should be Paragraph 83 and paragraph 178
should be removed.
Paragraph 7.25 under Flood risk last sentence
CORRECTION - Paragraph 184 should be Paragraph 174 and Paragraph
190 should be Paragraph 159
Paragraph 7.26 and Paragraph 7.27 under Soils and agricultural land
use
CORRECTION – all reference to Paragraph 184 of the NPPF
should be Paragraph 17

Under his delegated decision making powers in
the Officers’ Delegation Scheme in the Council’s
Constitution, the Chief Executive Officer has power, in cases of
emergency, to take any decision which could be taken by the
Council, the Executive or a committee.
Following on from the expiry of the Local Authorities and Police
and Crime Panels (Coronavirus) (Flexibility of Local Authority and
Police and Crime Panel Meetings) (England and Wales) Regulations
2020 (“the 2020 Regulations”), which allowed for
committee meetings to be held remotely, the County Council resolved
at its meeting on 5 May 2021 that, for the present time, in light
of the continuing Covid-19 pandemic circumstances, remote
live-broadcast committee meetings should continue, with any formal
decisions required being taken by the Chief Executive Officer under
his emergency decision making powers and after consultation with
other Officers and Members as appropriate and after taking into
account any views of the relevant Committee Members.
The Chief Executive Officer has taken all relevant information into
account in exercising his emergency delegated powers in this
matter, including considering the views of the Planning and
Regulatory Functions Committee.
The reasons for the decision in this matter are as follows:
•The principle of the development is necessary as an element
of the local sewerage infrastructure;
•The proposal would have minimal impact on residential amenity
and environmental quality;
•The proposal is compliant with NPPF, NPPW, PPG guidance,
‘saved’ policies of the North Yorkshire Waste Local
Plan (adopted 2006) and policies of the Selby District Core
Strategy Local Plan (adopted 2013)
Subject to the amendments in respect of the renumbering of the NPPF
dated 20th July 2021.
