The Sub-Committee considered the following:-

 

1.     Details of the application.

 

2.     The report from the Director of Environment including appendices 1-12.

 

3.     The written and oral representations on behalf of the licence holder.

 

4.     The written and oral representations of Other Persons, the written representations being detailed in appendices 4-10, and including the video recording produced during the sub-committee hearing.

 

5.     The Licensing Act 2003 (as amended).

 

6.     Guidance issued under Section 182 of the 2003 Act.

 

7.     Relevant licensing objectives as detailed in the written report.

 

8. Statement of North Yorkshire Council’s licensing policy.

 

The Licensing officer advised the Applicant already holds an existing Premises licence which allows for live and recorded music, late night refreshments and sale/supply of alcohol for at the premises, as detailed below,

 

• Live music indoor Monday - Sunday 18-00 – 00-00

• Recorded music Monday – Sunday 11-00 – 00-00

• Late night refreshments Monday – Saturday 23-00 – 23-30

• Sale/supply Alcohol Monday – Sunday 11-00 – 01-00 On and Off premises.

 

The Licencing officer confirmed the application relates to a variation to the layout of the premises to include a separate café, which is located within the existing licensable area as detailed on the plan submitted with the application. The Licensing officer also confirmed all Responsible Authorities had been consulted in relation to the application and that no representations had been received from any of the Responsible Authorities, the licensing officer confirming 7 representations had been received from other persons.

 

In reply to questions the licensing officer advised, other than two complaints in 2019 and 2024 in relation to underage drinkers at the premises, the Licensing authority had received no complaints in recent years in relation to this licensed premises.

 

Representations from all parties were considered alongside the report and cross questioning was undertaken.

 

Resolved –

 

That following consideration of all written and oral representations from all parties and taking into account all the above, it was unanimously agreed the application for a variation to the existing premises licence to change the layout of the premises as detailed in the report and accompanying plan should be approved, subject to the following conditions as proposed by the Applicant:-

 

1. There will be a maximum of 30 seats in the external seating area adjacent to the café at the premises and this area be closed for customer use from 21.00 hours daily.

 

2. There will be a maximum of 20 seats in the external seating area adjacent to the function room at the premises.

 

3. The Applicant complies with the noise management plan prepared by Nova Acoustics dated 27 and 28 June 2024, including undertaking regular noise monitoring at the premises during times when regulated entertainment is taking place.

 

4. Except for access and egress, all external doors and windows shall be kept closed at all times when licensable activities are taking place on the premises.
