Apologies for absence had been received from Councillors Haslam. 

The minutes of the meeting held on 26 May 2026 were confirmed and signed as an accurate record.

There were no declarations of interest.

The Head of Development Management, Community Development Services sought determination of an outline planning application for the construction of up to 130 dwellings with all matters reserved except for access.  Access was proposed from Chapel Hill and included the broad access and movement strategy shown on the submitted access and parameter plans on land comprising field 440099 465497 Stump Cross to Aldborough, Boroughbridge, North Yorkshire.

The application had been reported to Committee as the site raised significant material planning issues, such that it was appropriate for it to be considered by Members.

The Development Management Team Manager presented the report and highlighted the location and site description.  Members were advised that an officer update note had been published on the Council’s website and the update was summarised as follows:

• The Council had received one additional objection to the application, which reflected Yorkshire Water’s concerns regarding the capacity of the local sewer network to accommodate foul water from the proposed development.  Yorkshire Water had objected on the grounds of insufficient sewer capacity and the potential implications for flooding, pollution and public health, and advised that the submitted Flood Risk and Drainage Assessment did not adequately address these constraints.

However, Yorkshire Water confirmed that these concerns could be addressed through planning conditions requiring appropriate surface water drainage and sewerage infrastructure to be provided before development proceeded. Officers noted that the objection related to current capacity constraints rather than the principle of development and were satisfied that, subject to the recommended conditions, the development could be appropriately serviced without resulting in unacceptable impacts.  Accordingly, the issues raised were not considered sufficient to justify refusal of planning permission.

• Paragraph 10.89 of the report set out the open space contributions.  For clarity, the Section 106 requirements included both the financial contributions and the submission of an Open Space Management Plan for approval.
• There had been a number of amendments to Conditions 1, 3, 16, 23, 29,35 and 36 of the report.
• An additional condition was proposed which required details of surface water management during the construction phases to be submitted to and approved by the Local Planning Authority before any phase of the development commenced.

In addition, the Officer advised that the application description had been amended prior to publication of the report but had not been updated on Public Access. Accordingly, Members were recommended to be minded to approve the application, subject to the conditions within the report, and the officer update note, the prior completion of a Section 106 Agreement, and updating the application description on Public Access, with the final decision delegated to the Head of Development Management.

The Mayor of Boroughbridge, Councillor Zoe Metcalfe spoke on behalf of Boroughbridge Town Council, objecting to the application.

The agent, Simon Atha spoke on behalf of the applicant, in support of the application.

During consideration of the application, the Committee discussed the following issues:
