To elect a Member to act as Chair of the meeting.

Decision

That Councillor Derek Bastiman be elected as Chair for the duration of the meeting.

There were no apologies for absence.

All Members are invited to declare at this point any interests they have in items appearing on this agenda, including the nature of those interests.

There were no declarations of interest.

To confirm the procedure to be followed at the meeting.

Decision

The Sub-Committee agreed the procedure for the meeting as outlined by the Chair.

The Corporate Director – Environment sought determination by the Sub-Committee of an application for the grant of a pavement licence for The Treasury, 4 Baxtergate, Whitby, North Yorkshire YO22 4NX.

The options available to the Sub-Committee were:

·     To grant the licence as applied for, subject to the statutory conditions and the Council’s standard conditions

·     To grant the licence subject to modified conditions and/or amendments to the proposed layout, furniture or operating hours considered appropriate: or

·     To refuse the whole or part of the application.

Decision

The Sub-Committee determined to grant the application with modified conditions and amendments to the proposed layout and furniture.

The Sub-Committee found on the balance of probability that the grant of this licence with

1.   The statutory conditions

2.   The Council’s standard conditions and

3.   The modified conditions below

would ensure that the public highway remained safe and unobstructed for all users, public safety was maintained, accessibility would not be restricted and public nuisance would be prevented.

Modified conditions

1. No more than 8 tables with maximum dimensions of 730(H) x 600(W) x 600(D)mm

2. No more than 32 seats with maximum dimensions of 730(H) x 555(W) x 530(D)mm

3. A boundary railing with no more than 6 barrier screens and 9 barrier posts.
