Agreement for the submission of comments, collated from officers across the council, on the national consultation on a new draft national planning policy framework

The Executive Member for Open to Business approved submission of officer comments to the Ministry of Housing, Communities and Local Government (MHCLG) on the national consultation on a new draft National Planning Policy Framework (NPPF).

North Yorkshire Council must designate a neighbourhood area if it receives a valid application and some or all of the area has not yet been designated (Section 38A of the Planning and Compulsory Purchase Act 2004).
Tockwith with Wilstrop Parish Council submitted an application to North Yorkshire Council to designate the Parish Council area as a Neighbourhood Area. As per the regulations, the Council is required to designate the neighbourhood area without consultation as it relates to the whole of a single parish.
Whilst no decision is required of Executive Member or Officer, the application to designate the area is being identified for entry on the Forward Plan as there is more than one community/village within the proposed (Parish Council) area. As such, it has been placed on the forward plan for transparency and openness.

The Executive Member for Open to Business approved the designation of the Tockwith with Wilstrop as a neighbourhood area under Part 2(7) of the Neighbourhood Planning (General) Regulations 2012 (as amended), to enable the next stages of the development of a neighbourhood plan to commence.

To recommend the rate of payment to North Yorkshire Foster Carers to put in place from 1 April 2026

For the 2026/2027 Payment Rates for NYC Foster Carers (including Kinship Carers, Short Break and Specialist Short Break Carers and Staying Put arrangements) to be increased by 3.4% (in line with the December 2025 rate of CPI).

To increase the Day Care rate to £10.17 per hour (to keep in line with 80% of the level of the National Living Wage being introduced in April 2026).

North Yorkshire Council intends to enter an agreement with adjacent landowner to the Side Bank Wood Retaining Wall near Downholme, for the dedication of approximately 800m2 area of land for highway purposes pursuant to section 72 of the Highways Act 1980. The land is to be used to construct an embankment and reconstruct the retaining wall at the foot of the embankment.

To seek approval for the proposed fee increases to support the Council's Parking Principles, Local Transport Plan and ensure sustainable funding for transportation infrastructure and services.

That the new fees and charges 10 per cent uplift for parking charges, as set out in the report and appendices are approved to come into effect from 1 April 2026. That Blue Badge holder charges, where they currently exist in council car parks, are removed making Blue Badge Holder Parking free in all council run car parks. The financial impact of these changes being an estimated reduction of £1.7m in the level of income anticipated to be received compared to the 26/27 budget.

A decision has been made to:

Continue with the Electricity supply contract with EDF Energy Limited via the Crown Commercial Services (CCS) framework for the supply of electricity for the Council.

The current contract period is up until 31 March 2029.

The decision will ensure the continuity of the contract period until 31 March 2030.

Please note the decision related to the tariff will take place later in the year once indicative costs are available for the different tariffs. This is anticipated to take place September 2026.

Pest Control Fees 2026-27 are approved, as detailed in Appendix A of the report subject to the following amendments to the Education Annual Contracts to increase by 5% (with rounding to the nearest pound) which is consistent with the other treatment fees for schools:
• Education Comprehensive Package (NY Local Authority Schools) now £420.00
• Education Comprehensive Package (Non-Local Authority Schools) now £505.00
• Education Comprehensive Package (Outside NY Boundaries) Quote

The amendments are to ensure the service costs are adequately covered by the fees.

Fees for North Yorkshire Council’s Regulatory Services 2026-27 are approved as detailed in Appendix A of the report.

The budget position is noted (at Appendix A) and the proposed bids, as detailed in Appendix B of the report, are approved.

Acceptance of the of £97,000 grant funding from the Yorkshire Regional Flood and Coastal Committee Local Levy to design a nature-based solution pilot scheme to mitigate coastal erosion at Scalby Sea Cut, Scarborough.

To request authorisation to submit schemes to the Mayoral Active Travel Fund.

Authorisation to submit a bid to the York and North Yorkshire Combined Authority’s Mayoral Active Travel Fund for grant funding in the amount of £1,281,282 with a match funding contribution from North Yorkshire Council of £215,672.

Acceptance of £179,450 from the Yorkshire Regional Flood and Coastal Committee Local Levy to undertake a Property Flood Resilience (PFR) scheme for individual properties at significant tidal and main river flood risk around the Whitby Harbour subject to acceptable terms and conditions being received.

To notify of the intention that following acceptance and drawing down of the funding following approval of the business case, North Yorkshire Council will enter into contract with specialist PFR installers Watertight International Ltd to implement the scheme.

Approval to apply to Keeping Britain Tidy (KBT) for funding of £27,500 to purchase specialist chewing gum removal equipment.

The revised fees and charges for the Bereavement Service, as detailed in Appendix A of the report, are approved.

The fees and charges for Ceremonies and Premises in the Registration Service as detailed in Appendices A and B of the report, are approved.

To award two revenue schemes for rebuild and maintenance works for both Cow Dyke and Newby Hall North Retaining Walls using NEC4 ECSC Contract. The contract is to be awarded to Hinko Construction Ltd for the provision of carrying out the works for the sum of £84,926.04.

Chief Finance Officer (sub-delegated to the Assistant Director for Resources - Environment), to authorise the acceptance of the grant for the sum of £176,250 (to a maximum of £217, 074.75) from the Football Foundation to install a Playzone facility at Gallows Close, Scarborough.

To accept the Football Foundation grant offer for the sum of £217,074.75 for the purpose of installing a Playzone facility at the Gallows Close Centre, Scarborough subject to appropriate terms and conditions being agreed and agreement of the sources of match funding set out in the report.

An additional application for £326,000 of the Environment Agency Grant in Aid funding to enable the Upper Dales Flood Alleviation Scheme development during 2025-2026 has been authorised for submission.

To award a supply and construction contract to Streetscape Products & Services Limited at a value of £63,645.00 + VAT for capital funded improvements to play areas at Doublegates Avenue Ripon, Roberts Crescent Harrogate and St. Patrick’s Way, Harrogate. The improvements include the installation of new play equipment and the replacement of worn safety surfacing where required.

To award a supply and installation contract to Axo Leisure Services Limited at a value of £29,832.00 + VAT for wet pour (rubber) safety surfacing to play areas at Camwal Terrace, Starbeck, Harrogate; Long Acre Walk, Pannal, Harrogate; and Masham Recreation Ground, Masham. The improvements include the removal and replacement of existing worn surfacing at Long Acre Walk and Masham and overlaying existing surfacing with new wet pour at Camwal Terrace.

To award a supply and construction contract to Priestwood Vision Limited at a value of £61,682.00 for a replacement MUGA at Aireville Park, Skipton.

To award a supply and construction contract to Lightmain Limited at a value of £92,745.00 for a replacement MUGA at Bankside Eastfield.

To award a supply and construction contract to Wicksteed Leisure Limited at a value of £28,345.00 + VAT for providing additional play equipment (Multiplay Unit, Sensory Panel, Musical Totem and Mobile Phones) at Oakdale Play Area, Jenny Field Drive, Harrogate.

The Authority has awarded a contract to Integrated Skills Limited following an open bid procurement process.

The new contract commenced on the 12th of January 2026 for a period of 12 months.

The contract value is £99,394.00 (exc VAT).

The Executive Member for Open to Business has approved the response to the National Consultation on Overnight levy and this will be submitted as the North Yorkshire Council Response.

Decision on an Application submitted to the Rural Housing Fund

Following a recommendation of the Affordable Housing Funding Panel, the decision has been made to make a grant of £440,000 from the Rural Housing Delivery Fund to Broadacres Housing Association to support the development of 11 new affordable homes in Shipton by Beningbrough.

The award is subject to the development of a grant agreement and subsidy controls.

Following the consultation from Beadalm and Nawton Parish Councils submission of an Area Application to designate the combined entirety of both Parishes to become a neighbourhood area, we are seeking approval for the proposed neighbourhood area.

The Executive Member for Open to Business approved the designation of the Nawton and Beadlam as a neighbourhood area under Part 2(7) of the Neighbourhood Planning (General) Regulations 2012 (as amended), to enable the next stages of the development of a neighbourhood plan to commence.

To make an Order under section 91(1) of the Local Government Act 1972 temporarily appointing Councillors Caroline Goodrick, Janet Sanderson and Nigel Knapton, to Whitwell-on-the-Hill with Crambe Parish Council, to take effect upon the sealing of the Order.

This decision is taken under the delegated powers of the Assistant Chief Executive Legal and Democratic Services and Monitoring Officer.

That NYC, acting as Shareholder/owner of NYnet Limited (the “Company”), has approved:

The report will highlight the Year 1 progress on the North Yorkshire element of the GYNYW Economic Inactivity Trailblazer programme and propose an outline of the programme for Year 2.
Approval is required to support acceptance of a grant over £500,000 in order to deliver the programme.

Approval has been given to accept recurrent Year 2 grant funding to support the Get York North Yorkshire Working Economically Inactive Trailblazer programme. This is subject to final confirmation of funding amounts and that grant funding conditions remain acceptable to North Yorkshire Council.

That the Assistant Director Resources (Community Development) authorises the acceptance of a grant of £8,750 from the High Street Rental Auction Fund for the production of a Vacancy Register for Scarborough Town Centre.

To revoke the ETRO which was approved via a previous decision record (reference 127/25) and approve the re-making of the order:

i. for the making of an Experimental Traffic Regulation Order prohibiting goods vehicles in excess of 7.5t between the hours of 07:00-09:30Hrs and 15:00-16:30 Hrs Monday-Friday on Hambleton Grove, Knaresborough;
ii. the Corporate Director - Environment be authorised to make minor changes within the first six months of the ETRO;
iii. in line with the procedure for ETROs, before the expiration of 18 months a further report is brought, in order for a decision to be made on whether to make the Order permanent, amend it or remove it.
