Considered – A report of the Corporate Director Environment in which approval was sought to apply for grant funding from Flood Defence Grant in Aid (FDGiA) administered by the Environment Agency to continue the North East Regional Coastal Monitoring Programme (NERCMP). The grant application formed part of a joint national funding business case developed on behalf of the Coastal Groups of England and undertaken by the lead partners of the National Network of Regional Coastal Monitoring Programmes of England, one which NYC was one.
The Executive Member for Highways and Transportation stated that NYC was the lead local authority for NERCMP and the funding covered 100% of all costs, which included data collection and analysis. The Corporate Director, Karl Battersby, confirmed that this was the 4th phase of the programme and NYC was responsible for the co-ordination of assessment and monitoring of the coastal environment.

Reasons for recommendations
As a Risk Management Authority, North Yorkshire Council, under the Flood and Water Management Act 2010, is required to act in a manner that is consistent with the National Flood and Coastal Erosion Risk Management Strategy for England and work collaboratively with other RMAs. Undertaking the role of lead Authority for the North East monitoring region allows the Council to do this.
Being the Lead Authority allows the Council to steer and shape the monitoring programme to collect and analyse data that creates the greatest benefits and outcomes to meet local demand both along the North Yorkshire frontage and wider North East region.
The project is 100% grant aid funded and recommended by the adopted Shoreline Management Plan and local coastal strategies. The National Network of Regional Coastal Monitoring Programmes is a long established and is a priority project programme for the funder the Environment Agency, DEFRA and the client, the North East Coastal Group. Should approval be given, and grant awarded, North Yorkshire Council will continue to a leader in its field and a centre of excellence of coastal management and monitoring both nationally and internationally.
Alternative options considered
There are no feasible alternative options to consider other than to apply for the 100% grant funding or not as the lead partner for the NE Region. This is nationally strategic and important priority project that will be delivered with or without NYC involvement, subject to funding.
North Yorkshire Council is the current lead Authority for the delivery of the North East Regional Coastal Monitoring Programme through the inhouse North East Coastal Observatory. Due to the specialised skills, knowledge and understanding of the North East Coastal Observatory team, NYC remains the lead Authority within the new National Monitoring Programme business case. Being the lead Authority allows us to shape and steer the monitoring programme to deliver the data required by local and regional coastal managers, responsible bodies and our communities.

Therefore the following decision has been taken by the Corporate Director of Children & Young Persons Service in consultation with the Executive Member for Education Learning and Skills agreed to undertake a consultation regarding discretion for a ‘nearest gate in the federation’ for home to school travel arrangements to Middleham and Spennithorne schools which would be conditional upon the Federation of Middleham (VA) and Spennithorne (VC) CE Primary Schools continuing to provide support with inter-school transport where that is required under the home to school travel policy proposed by the Governing body of The Federation of Middleham (VA) and Spennithorne (VC) CE Primary Schools as a result of these statutory organisation proposals.

To abandon the Procurement under the Concession Contract Regulations 2016 (CCR 2016)
The Authority has undertaken a detailed review of the procurement process initiated in November 2024 for the provision of electric vehicle (EV) charging infrastructure. Following this review, the Authority has determined that the procurement must be abandoned in accordance with Regulation 40 of the Concession Contract Regulations 2016 (CCR 2016) . The decision has been reached based on the following material considerations:
1. Significant Changes in the EV Market Landscape
Since the procurement commenced, the EV charging market has undergone fundamental change, including shifts in ownership among charge point operators and associated implications for commercial modelling. These developments have resulted in the need for substantial amendments to the proposed contract terms to ensure they reflect current market conditions. As these changes are material in nature, the contract is no longer deliverable in its current form.
2. Concerns Regarding Scheme Viability and Wider Economic Conditions
Delays in the procurement process, combined with uncertainty surrounding the viability of key scheme deliverables, have raised concerns about the overall feasibility of continuing with the current approach. In addition, global volatility in energy tariffs has introduced further risk, making continuation of this procurement economically unviable for the Authority at this time.
3. Inability to Meet Key Objectives of the Council’s EV Strategy
The current procurement approach would not successfully achieve several core elements of the Council’s EV Strategy. Proceeding without addressing these gaps would risk failing to deliver the strategic, commercial, and operational outcomes required.
4. Additional Market and Contractual Factors
o Ownership of electricity meters: Under the existing structure, the Authority retains ownership of electricity meters, a position that is no longer operationally or commercially desirable.
o Standing charges and commercial impact: The market is experiencing notable increases in standing charges, including instances where these are uncapped. This trend significantly affects project viability and requires contractual mechanisms that are not currently reflected in the existing procurement documentation.
o Market evolution: The EV charging sector has shifted at pace, and the market picture today is materially different to when the procurement commenced. A revised approach is required to ensure alignment with current supplier models and market realities.

The provider will collect rent directly from residents and manage tenancy agreements. They will also manage utility contracts, sub-metering, and recharges to tenants, ensuring accurate billing and payment to suppliers.
The domestic abuse support element is funded through an annual grant of £50,000. However, this funding is not guaranteed for the full contract term and is subject to annual confirmation.
The contract will run for an initial period of two years, with the option to extend for up to two additional one-year periods, subject to performance and funding availability.

The contract for the provision of the shared cost AVC scheme for employees in the Local Government Pension Scheme to further save towards their retirement will expire on 2 May 2026. The Authority is looking to re-procure a contract for the continued provision of this scheme.
There are currently 518 employees with salary sacrifice agreements in place for this scheme. The continued offer will ensure current and future employees retain the option of saving towards their retirement on top of their LGPS, while making savings on their tax and National Insurance contributions. The council also achieves savings via employer national insurance savings arising from those participating in the scheme and the reduction on their gross pay.
The decision to be taken relates to procurement of the scheme which has a significant published contract value, with the council paying costs to administer the scheme as a percentage of the value of the salary sacrificed sums. Based on current council costs and trends in increasing employee participation, this will potentially reach and go beyond £500k over the course of the contract of 4 years. Additionally, savings arising from participation in the scheme were £262.5k in 24/25 and are projected to be £340k in 25/26 and follow a similar trend in future years.
This is an in/out spend resulting in the council saving on the participation rather than spending from existing budgets.
