The Corporate Director – Business and Environmental Services (BES) and the BES Executive Members noted the outcome of the updated review into parking permit prices. In particular the revised figures that simplify the charging structure and updated analysis of the legal aspects of the proposal having regard to current legislation, case law and statutory guidance.

Their decision was to proceed with the recommended increase to the charges for residential permits in line with the revised figures set out in Appendix 2 subject to the following additional information.

The Corporate Director and the Executive Members also considered whether the provision of season tickets in Harrogate should continue as this appeared to be counter productive to the Scheme. It was decided that the provision of season tickets is assessed to fully understand their use and any implications should they be removed from the permit scheme.

(i) A new operating model for adult social care be implemented (as set out in section 3 and Appendix 1 of the report), in response to the national Hospital Discharge Requirements, working with the NHS, using existing Care Act and other legislation, as is now, until such time as emergency powers under the Coronavirus Act 2020 need to be invoked.

(ii) A new model of delivery for adult social care be implemented, at such time as the situation requires during the Covid-19 pandemic, that will:

• assist the NHS in freeing up North Yorkshire’s share of 30,000 NHS beds nationally
• enable urgent work to support people living in the community who have a Covid-19 diagnosis or symptoms (particularly where people are at the end stage of their lives)
• ensure that, whilst taking account of the national legislation and guidance and the prioritisation necessitated by the Covid-19 response a) people requiring urgent social care assessment and/or support for non-Covid-19 issues continue to be offered an appropriate level of advice, information and support and that b) people with current and ongoing needs receive appropriate support which may include alternative arrangements to their normal service.

(iii) The power to invoke measures as set out in the Coronavirus Act 2020 and in the report, be delegated to the Corporate Director Health and Adult Services (as the Council’s statutory director of adult social services), and that the Chief Executive Officer take that decision in consultation with the Executive Member for Adult Social Care and Health Integration, the Assistant Chief Executive (Legal and Democratic Services), and following advice from the Director of Public Health and the Assistant Directors with responsibility for adult social care.

(iv) Any triage or case/review decisions as set out in section 5 of the report and in Appendix 2 be documented.

(v) If emergency powers are invoked as set out in the report, the situation be reviewed fortnightly by the Corporate Director for Health and Adult Services in consultation with the Assistant Director / Chief Social Care Practitioner (or in their absence, the Head of Practice), or their nominated representatives, as per Government guidance.

Option 3 – develop proposals to provide up to £1.4m of financial support to providers remaining open during the summer term and financial support to “key providers” enabling NYCC to fulfil its statutory responsibility to ensure sufficiency of provision across the county.

Option 5 – Provide additional funded places for “open” provision during Easter – decision taken by Corporate Director – Children & Young People’s Services.

“As an exception to the above, driven inspections can be carried out from a slow moving vehicle without a dedicated driver being present in low risk situations on category 4b roads, and in the event of a Government declaration of threat to public health for the duration of the declaration made under statutory provisions. This would be in situations where any actionable defects can still be identified and there are no additional public safety risks from not having a dedicated driver. In such circumstances the normal safety inspection vehicle may be replaced with an appropriately liveried Highways Officer’s van. In urban areas, the inspection will be carried out at no more than 10 mph on category 4b roads and 20 mph on higher category roads and in both directions and the Highways Officer must walk any sections where parked vehicles restrict the view of the full highway extent. A record must be kept of the inspection method used including those occasions where the inspection was conducted between 20mph and 30mph in rural locations;

iii. that such amendments are only to be effective for the duration of the public health response period as conferred by the Coronavirus Act 2020 and the Health Protection (Coronavirus Restrictions) (England) Regulations 2020 and made by Government declaration;

To make, under delegated powers, the following changes to the Locality Budgets Scheme for the 2020/21 year:

a) The Locality Budgets and Environmental Budgets schemes be combined into one scheme known as Locality Budgets; with the total budget allocation per County Councillor being £10,000.

b) County Councillors be able to make recommendations from 1 April 2020 (rather than the second Monday in May) with the last date for recommendations being 31 January 2021.

c) The minimum funding which can be recommended by a County Councillor for a project or activity is £300 and the maximum £5,000. Two or more County Councillors can jointly recommend funding for a project or activity, but the maximum total funding for any project or activity in a financial year is £5,000. However, for humanitarian projects linked to the Covid-19 pandemic the restriction of £5000 per project or activity is removed to allow County Councillors to jointly fund larger humanitarian initiatives.

d) In order to allow decisions to be made more quickly and to reduce the administrative burden on officers running the scheme during the Coronavirus pandemic, the Chairman of the County Council and the Chairman of Corporate and Partnerships Overview and Scrutiny Committee have consented to subsequent allocation decisions by the Executive Member for Stronger Communities being dealt with on an urgency and call in exemption basis.

e) Although recommendations have to be for projects or activities that directly promote the social, economic or environmental wellbeing of the communities they represent, County Councillors are particularly encouraged to focus on projects or activities that respond to local needs and community initiatives arising from the impact of Covid-19 pandemic, the impact of climate change, and/or promote the Council’s Stronger Communities programme.
