To undertake a variation to contract 48877 - Income Management and Card Payment Solution - to include the addition of a deliverable to support the consolidation of system instances under the contract and the associated charge. Extension to the contract expiry date to 31 October 2027. The value of the variation is £386,767.99.

That the Executive Member Cllr Dadd and the Leader Cllr Les agreed a tender process be undertaken to procure a Customer Relationship Management (CRM) platform solution that meets the needs and requirements of the Council, its citizens and the outcomes identified in the ongoing Customer Transformation Programme (CTP) to utilise our digital and technical solutional across the council. The technical assessment has determined that we need a low-code platform solution, integrated contact centre omni channel provision, and options to seamlessly integrate telephony. This will significantly accelerate our delivery of digital services which will improve the customer experience and maximise our resource.

To seek authorisation for submission of schemes to Active Travel Fund tranche 5.

The submission of five schemes listed within the report to Active Travel England’s assurance process is approved, as part of the Active Travel Fund tranche 5 submission process.

To review the Assistant Chief Executive Legal and Democratic Services’ scheme of sub-delegation and make the sub-delegations to their Assistant Directors and other senior officers as set out at Appendix 1, subject to any limitations set out therein.

To seek approval to accept the annual grant from the Department for Education offered to the Council for the purpose of providing a county wide offer of Holiday Activities and Food for free school meal eligible children for a minimum of 4 hours per day for 4 days over the Easter school holidays; a minimum of 4 hours per day for 16 days over the Summer school holidays and a minimum of 4 hours per day for 4 days over the Christmas school holidays

The Executive Member has approved the acceptance a grant in the sum of £1,420,280 from the Department for Education to deliver the national Holiday Activities & Food Programme (HAF) for North Yorkshire in 2025/26.

To recommend the rate of payment increase to North Yorkshire Foster Carers to put in place from 1 April 2025

The Executive Member for Children & Families has agreed to
• Increase the rates for payment of allowances and fees to NYC Foster Carers for the 2025/26 Financial Year by 2.5%.
• To increase the Day Care rate to £9.77 per hour in line with the increase to the National Living Wage

To agree the High Needs Budget for 2025-26, setting out the financial pressures and funding available for expenditure that fall within the High Needs Block of the Dedicated Schools Grant.

To seek approval for an application for recoverable grant funding from the Brownfield, Infrastructure and Land Fund (BIL) to allow early provision of infrastructure on the West Harrogate project. The funding will be put towards delivery transport and education schemes identified through the West Harrogate planning applications.

Approval from the Corporate Director Resources (sub-delegated to the Assistant Director Resources) in consultation with the Executive Member for Finance and Resources and the Executive Member for Open to Business to authorise the submission of an application for BIL (Brownfield, Infrastructure and Land) grant funding in the amount of £6,780,994.

The submission of application to Keep Britain Tidy (KBT) for funding of £27,500 to purchase specialist chewing gum removal equipment is approved.

To seek approval for submission of application for a North Yorkshire Lane Rental Scheme to the Department for Transport for Secretary of State sign off for implementation. Submission deadline is 1 April 2025.

Approval to submit a formal application to the Secretary of State to implement a Lane Rental Scheme.

To note the significant consultation exercise and the response provided was considered as part of the decision.

To update the Local Management of Schools (LMS) Procurement And Contract Procedure Rules to reflect the new Procurement Act 2023.

The Corporate Director – Children and Young People’s Service in conjunction with the Executive Member for Education Learning and Skills has approved the change to North Yorkshire Council’s Local Management of Schools (LMS) Procurement and Contract Procedure Rules.

Following the publication of statutory notices, to determine whether to close Hackforth and Hornby, Church of England Primary School, effective from 31 August 2025.
If there are no objections to the statutory notices, this decision will be taken by the Executive Member for Education, Learning and Skills at the meeting with the Corporate Director - Children and Young People’s Service

The Executive Member for Education & Skills has approved the decision to cease to maintain Hackforth and Hornby Church of England Voluntary Controlled Primary School with effect from 31 August 2025, together with the future arrangements for the School’s current catchment area.

Following the publication of statutory notices, to determine whether to change the age range at The Wensleydale School and Sixth Form, effective from 31 August 2025, by ceasing the Sixth Form Provision.

The Executive member for education & Skills has approved the proposal to change the age range at The Wensleydale School and Sixth Form, effective from 31 August 2025, by ceasing the Sixth Form Provision

North Yorkshire Council intends to adopt approximately 30m2 of unregistered land to the northeast of Foregill Bridge for highway purposes pursuant to section 228 of the Highways Act 1980. The land is to be used to widen the bridge and access the bridge for general inspections and maintenance.

To authorise the acceptance of the Public Sector Decarbonisation Scheme Phase 4 grant, following confirmation that NYC’s application has been successful.

This funding stream is being made available by the Government to provide public sector bodies with access to funding to support heat decarbonisation schemes in their properties.

The Director of Public Health is asked to approve the new substance use services operating model that will be implemented from 1 April 2026.

The Assistance Director - Resources CYPS has accepted the grant for £499,000

To agree the proposed extension to the existing joint agreements with the NHS for the commissioning and operational delivery of the Harrogate and Rural Alliance (HARA)

Approval has been given to extend the existing Section 75 agreements and Alliance Agreement for the Harrogate and Rural Alliance (HARA) for a period of 12 months, plus an additional 12 months if required.

The Assistant Director- Resources CYPS authorises the acceptance of the grant of £19,200

To submit North Yorkshire Council’s agreed formal response to the consultation on the draft Yorkshire Dales National Park Management Plan 2025-2030 that closes on 10 March 2025.

The Council accept the grant of £1.256m from Active Travel England’s Consolidated Active Travel Fund

That existing land, currently not recognised as highway, which borders the south side of Yafforth Road, Northallerton (north of Barkers) will become Highway Maintainable at Public Expense. See attached plan

To outline the rationale for the Council to accept £425,000 of pre-awarded grant funding from the National Lottery Reaching Community Fund. This funding will finance the delivery of the Council’s Swift: Enabling Sustainable Migrant Communities in North Yorkshire project. The project will be delivered for migrant communities across North Yorkshire and thus falls within the key decision criteria. Corporate agreement is needed before a formal grant agreement can be entered into with the funder.

To accept £425,735 over three years of external grant funding from National Lottery Reaching Communities Fund in agreement with the Executive Member for Finance and the Executive Member for Corporate Services.

To accept the recommendation by Councillor David Staveley to award £1,500 of his Locality Budgets funding to fund the replacement of rotten wooden window frames at Rathmell Reading Room.

To accept the recommendation by Councillor David Staveley to award £1,440 of his Locality Budgets funding to fund the purchase and installation of an interpretation board for Harrison Playing Fields with Giggleswick Parish Council.

To accept the recommendation by Councillor John Ritchie to award £690 of his Locality Budgets funding to fund the refreshments, training, craft materials and utility costs of the Wellness Café at St Luke's Church.

To award a contract for Hard Facilities Management Fire and Intruder Alarms: Servicing and Responsive Maintenance for North Yorkshire Council, following the completion of a procurement exercise to:

The Corporate Director of Resources, in consultation with the Corporate Director of Community Development, and Assistant Chief Executive Legal and Democratic Services, has provided the necessary authority for the Council to enter into the construction contract, including any associated project manager and supervisor appointments, to carry out the Whitby Maritime Hub Project

To accept a grant of £70,000 from the Ministry of Housing, Communities and Local Government (MHCLG).

North Yorkshire has now received confirmation that continued additional funding will be made available in 2025-26, via separate direct award section 31 grants (Drug and Alcohol Treatment and Recovery Grant [DATRIG] and Individual Placement and Support Grant [IPS]).

The Corporate Director – Health and Adult Services is asked to inform the Chief Finance Officer of their approval for:

The Corporate Director – Health and Adult Services has informed the Chief Finance Officer that the council will receive direct award grants to support improvements in the quality and capacity of drug and alcohol treatment and recovery from 2025-26. Leeds City Council will also receive a direct award grant, inclusive of an allocation for North Yorkshire (for as long as the council is a member of the consortium), as lead for the Inpatient Detoxification Consortium, to fund additional medically managed inpatient placements.

The Housing Service wish to procure two contracts for: -
• Damp, Mould and Timber Surveys & Works
• Auditing of Damp, Mould and Timber Surveys & Works
for the housing stock requirements.
Both would be a 1-year contract.
Potential contract start date April/May 2025.

The Executive Member has approved for the proposed increase in the Academy conversion charge for the 2025/26 financial year to £7,600.

To accept the recommendation by Councillor David Staveley to award £950 of his Locality Budgets funding to fund the purchase of equipment and help with weekly meetings at Lawkland Young Farmers Club.

To accept the recommendation by Councillor Kirsty Poskitt to award £1,000 of her Locality Budgets funding to provide support towards the heating costs at Tadcaster Library.

i) Use existing Homes for Ukraine (HFU) tariff funds received to top up sponsor thank you payments for years two and three, where relevant, of the visa term (decision already made to top up year one).
ii) Use existing HFU tariff funds received to top up UK sponsor thank you payments during the UPE (18-month period beyond HFU).

To authorise the extension of existing automated carriageway surveying system contract and procurement of a carriageway skid resistance surveys.

Authorisation to call off a contract from the NYC procurement framework for the supply of automated highway asset data collection and processing 1 April 2025 to 31 March 2027 and procure a contract for the supply of carriageway Skid Resistance Testing from 1 April 2025 to 31 March 2027.

To agree the schemes to be included within the 2025-2026 Highways Capital Annual programme.

The updates on the 2024/25 annual programme are noted and schemes for delivery as part of the 2025/26 annual programme were approved.

It is agreed to the publishing of the North Yorkshire Permit Scheme Evaluation Report for years 4 – 6 and note a further report seeking a review of permit scheme fees and charges will be submitted in due course.

The report is to seek approval for the revision of highway design guidance chapters, to bring them up to date with current best practice.

It is approved that:

i Guidance on 278 and 38 agreements and the new NY Highway Specification is agreed and published and used to inform the decisions of the LHA in relation to its role as statutory consultee on planning applications and in the context of highway adoption from 1 March 2025 and

ii future decisions concerning guidance and specification are delegated to the Assistant Director, Highways and Infrastructure and Head of Network Strategy to efficiently permit future guidance and specification chapters to be amended and updated as required.

Appointment of a contractor for works to convert a former hostel into 6 flats following a competitive tender.

A total of 6 contractors tendered for the works which included but was not limited to:

• Facilitating works – to include but not limited to security and fencing and demolition
• Super structure works
• Internal finishes including fittings furnishings and equipment
• Services
• External works
• Any necessary approvals – LABC, building Regulations, discharge of planning conditions etc
• Provision of a handover pack

A JCT design and build contract will be entered into. The works will take place over a period of 3.5 months subject to extensions if required.

To approve the updated policies for North Yorkshire Council Archives & Records, for the purpose of guiding day to day management of the archive and for maintaining accreditation.

For the Corporate Director Environment, under delegated powers, to approve the introduction of the Traffic Regulation Orders required for the Selby Transforming Cities Fund project.

The results of the consultation exercise were noted and

i the making of Traffic Regulation Orders (TROs) as shown in Appendix A of the report is approved;

ii that the Assistant Chief Executive (Legal and Democratic Services) be authorised to seal the relevant Traffic Regulation Order by the Corporate Director, Environment and Environment Executive Member for access in light of the objections received and that the objectors are notified within 14 days of the order being made.

To inform the Executive Member of the current service fees and charges structure and to obtain approval for fees and charges for the Registration Service for the financial years 2025-2028

The fees and charges for the Registration Service for ceremonies for the financial years 2025/26 to 2027/28 were approved, including:

i fees and charges for ceremonies by uplifting by inflation and introducing fees one year further in advance
ii weekday fee changes to provide further choice for couples
iii licensed venue fee increases
iv the removal of licensed venue fees for Town and Parish Councils.

To inform the Executive Member for Managing our Change of the current service fees and charges structure and to obtain approval for fees and charges for the Bereavement Service for the financial year 2025-2026

The fees and charges for the Bereavement service 2025-26 were approved:

i Fees and charges for the Bereavement Service for 2025-2026
ii Fees harmonised where appropriate.

Noting an amendment to Skipton Cremation and Service from £945 to £1095

To approve the introduction of a revised set of Highways and Infrastructure fees and charges schedule with effect from 1 April 2025.

The increase in fees and charges already approved by Full Council is noted and the introduction of a revised set of fees and charges is approved, as set out in Appendix 1 of the report, including for S50, S171 and S184 licences and Temporary Traffic Regulation Orders (TTROS).

To consider whether to make any variation to the current hackney carriage and private hire licence fees. If changes are proposed, to approve the publication of the relevant statutory notices.

The retention of the existing hackney carriage and private hire licence fees are approved for a further year.

To consider a variation to the current discretionary general licence fees.

The proposed variation to fees and charges in Appendix A to the report relating to the Council’s scrap metal, sex establishments, animal welfare, street trading and gambling licensing functions, effective from 01 April 2025, are approved.

To feedback the results of a public consultation on outline proposals for improvements to Whitby harbourside public realm, including proposals to signalise the junction of Spital Bridge and A171 and decide on the next steps for the scheme.

The 2023 consultation outcome for zone six, A171 New Bridge/Spital Bridge junction improvement is noted and

i approval be given to proceed with the amended scheme for A171 New Bridge/ Spital Bridge junction improvement, zone six, as shown in Appendix C of the report;

ii a further report concerning the 2023 consultation outcome for Whitby Harbourside Public realm scheme zones one to five, and any amended proposals for zones one to five, be brought to this committee in summer 2025.

To approve acceptance of additional funding of £548,141 from the Ministry of Housing, Communities and Local Government for Local Authority Housing Fund Round 3.

This report follows an announcement made by the Dales Academy proposal to close Kirkby Fleetham Church of England Primary School at the end of the Summer term 2025.
The school is identified as a rural academy.
In accordance with the presumption against closure of rural academies, the Local Authority needs to agree to the closure.
The report will seek the Local Authority’s agreement to the proposed closure of the rural academy.

The Council notes the Substantive Closure Decision taken by the Secretary of State on 29 January 2025 under the DfE’s “Closure of an academy by mutual agreement” guidance dated October 2024.

The Council does not oppose the decision already taken by the Secretary of State on the 29 January 2025 to close Kirkby Fleetham Primary School.

To agree on a stakeholder consultation on catchment area proposals to be
effective from September 2025 that:
• The shared catchment area of Applegarth and Kirkby Fleetham becomes a
discrete catchment area for Applegarth Primary School.
• The discrete catchment area of Kirkby Fleetham becomes a discrete catchment area for Aiskew Leeming Bar CE Primary School

To accept the recommendation by Councillor Andrew Lee to award £1,850 of his Locality Budgets funding to fund the purchase and installation of a defibrillator for Little Fenton Parish Council.

The decision is required to undertake the procurement for a contract for the replacement of Doors and Windows in the Council’s Social Housing across North Yorkshire.
There is a current contract in place that covers only the old legacy area of Harrogate. This contract expires in September 2025, with an option for a 12-month extension.
Currently, there is no formal contract in place for Selby and RiDC. The new doors and window contract will cover both Selby and RiDC, with the option to include the Harrogate area when the Harrogate contract expires.

Procure a new doors and windows contract to initially serve both Selby and RiDC, as neither currently has a formal agreement in place.

This contract will have a term of two years, with the option to extend for an additional two years (1+ 1+ years). Performance under the contract will be managed and monitored by the Housing Standards Team.

The former Harrogate area will be incorporated into this contract in the future. The existing Harrogate contract expires in September 2025, with a possible 12-month extension. Prior to any extension decision, a determination will be made regarding the amalgamation of the Harrogate area into the new Selby and RiDC contract.

To accept the recommendation by Councillor David Hugill to award £2,310 of his Locality Budgets funding to fund the venue hire and purchase of musical instruments for Osmotherley Music Group for St Peters Church Council Osmotherley.
