Purpose:

To determine requests made by certain district/borough councils under section 24 of the Local Government and Public Involvement in Health Act 2007 regarding Chief Executive settlement agreements.

Decision:

The Leader has granted Section 24 consent for the Chief Executive settlement agreements for Craven District Council, Harrogate Borough Council, Richmondshire District Council, Ryedale District Council and Selby District Council on the terms agreed in their respective Councils’ reports.

Reasons for the decision:

The Leader accepts that the district and borough councils have a right to make decisions about their Heads of Paid Service whilst they are in existence. The district and borough councils named above have taken full and comprehensive reports to their respective Councils and have approved what they consider to be appropriate settlements for their Heads of Paid Service. The Leader therefore grants the necessary consents for them to implement those decisions as required.

Alternative options considered:

The request for consents could be refused could result in legal action being taken against the new Authority and opens up additional costs and expense in unnecessary litigation when decisions have already been made by the districts and the borough to enter into relevant settlement agreements. The cost implications have been considered by the district and borough councils directly and there will be subsequent savings for the new Authority.
