To seek approval for the revised secure and
introductory tenancy agreements which need to be adopted by North
Yorkshire Council following consultation.
Approval has been given to undertake the
following:
• For the service of a Preliminary Notice under Section 103 of
the Housing Act 1985 to advise tenants of the proposed variation to
the tenancy agreement under Section 102 and seek their
comments.
• To commence formal consultation with tenants on the proposed
NYC Tenancy Agreement in accordance with Section 105 of the Housing
Act 1985 and Section 137 of the Housing Act 1996.
• To undertake a separate consultation with tenants, again in
accordance with the Housing Acts 1985 and 1996, on proposed
amendments to the NYC Tenancy Policy, specifically the introduction
of a 52-week rent collection period and potential change to tenancy
start day.
Registered Providers (and which includes North
Yorkshire Council) are required by law to meet the expectations set
out in the Regulator of Social Housing’s consumer standards
(Tenancy Standard). The Tenancy policy has been updated to ensure
that we can fulfil the expectations set out in this particular
standard.
Likewise, the harmonisation of Tenancy Agreements is a necessary
and strategic step in the transformation of housing services
following local government reorganisation. The proposed NYC Tenancy
Agreement will provide a consistent, legally compliant, and
tenant-focused framework for all tenants across the Council’s
housing stock.
It is a requirement of the Regulator of Social Housing
Transparency, Influence and Accountability standard for a
Registered provider, ‘to take tenant’s views into
account in their decision making about how landlord services are
delivered and communicate how tenant’s views have been
considered.’
It is also good practice and in line with North Yorkshire Councils
own consultation principles to consult on a policy which concerns a
significant number of its residents (tenants).
