Decision Maker: Executive Member for Education, Learning & Skills

Decision status: Recommendations Approved

Is Key decision?: Yes

Is subject to call in?: No

Decision:

To approve the expansion of St Mary’s Roman Catholic Primary School, Malton, by 60 places. The implementation would be conditional on securing planning permission under Part 3 of the Town and Country Planning Act 1990 by 30 June 2018.

Reasons for the decision:

*PLEASE NOTE This decision was originally published on or near the date of the decision and so call in no longer applies. It has been re-published as part of the change in committee management system that we use.*

The Executive agreed on 17 October to the publication of a statutory proposal to expand St Mary’s Roman Catholic Primary School, Malton, by 60 places increasing the capacity from 150 to 210 places overall. 2.2 This constitutes a significant enlargement under School Organisation regulations and requires that a statutory process be followed.

Following approval of the Executive on 17 October, statutory notices were published for a period of four weeks and within that time no representations were received regarding the proposal.

Under the arrangements agreed by Executive on 25 September 2007, school organisation decisions, for which the decision maker is the Local Authority, will normally be taken by the County Council’s Executive or, if there are no objections to the Statutory Notice, the decision is delegated to the Executive Member for Education and Skills.

Alternative options considered:

In considering proposals for a school expansion, the Executive Member for Education & Skills as decision maker can decide to:
? reject the proposal
? approve the proposal
? approve the proposal with modifications
? approve the proposal subject to them meeting a specific condition
