Purpose:

To seek approval of North Yorkshire Council's Dog Control Public Spaces Protection Order

Approved:
• the Dog Control Public Spaces Protection Order (‘the Order’) 2025, as set out at Appendix 2 in the report;

• the Assistant Chief Executive Legal and Democratic Services to make the Order by affixing the Council Seal to the Order; and

• officers to publicise the Order once made, in accordance with legal requirements.

Reasons for the decision:

To provide a clear and continuing legal framework for the effective control of dogs on the North Yorkshire coast.

Alternative options considered:

There are no alternatives and to do nothing is not an option. The legal framework around PSPOs superseded and consolidated previous legislation for dog control, therefore without an appropriate PSPO and proportionate restrictions it would bring significant reputational risk to the Authority and increase the risk of dog related anti-social behaviour along the Coast.

The former Scarborough Borough Council had a PSPO for dog control since 2018 and is the only Borough / district council that had one. Elsewhere across North Yorkshire restrictions are covered in Byelaws and other legislation which remains in place and this will be reviewed by the Council in due course.
