Minutes for the Meeting held on 9 July 2025 Minutes: Members considered the minutes of the Planning Committee meeting held on 9 July 2025 contained within the agenda pack, along with the proposed amendments to the minutes which had been circulated to all Members.
The following amendments to the minutes were proposed:
At minute number 95 – ZG2024/0023/FULM - Land north of Hull Road, Hemingbrough, following the decision, under the heading Reason it stated the word condition in four places in error, this was to be replaced with the word “reasons”, and with the two additional reasons to be numbered as reason 08 and 09.
It was proposed, seconded and a vote taken.

To approve the minutes of the Planning Committee meeting held on 9 July 2025 for signing by the Chairman, subject to the amendments detailed above. |

Declarations of Interests Minutes: Councillor Arthur advised that he had received correspondence from the applicant and Barlby and Osgodby Town Council in relation to item 4 of the agenda pack. He confirmed that although it was within his division area he had not expressed an opinion on the application and would speak and vote on the item.

2023/0222/FULM - Land off the Fossards, Osgodby, Selby, North Yorkshire Additional documents: Minutes: The Assistant Director Planning, Community Development Services sought determination of a full planning application for residential development comprising 20 new dwellings along with site road and associated drives, parking and landscaping at land off the Fossards, Osgodby, Selby, North Yorkshire.
The application had been reported to Committee as the Head of Development Management considered the application to raise significant planning issues such that it was in the public interest for the application to be considered by Committee.
The Principal Planning Officer informed Members that there was an officer update note on the application and highlighted a correction to the report at paragraph 7.2. Additional comments had also been received from the Affordable Housing Officer which confirmed that the location of the proposed dwellings was acceptable, and which requested that the dwellings be provided as social rent, as this was considered to be the greatest need for the area.
Lee Machell, spoke on behalf of the applicant, in support of the application.
During consideration of the above application, the Committee discussed the following issues:
· Members sought assurance that the portion of the application site located within Flood Zone 3 would remain undeveloped. · It had been noted that Barlby and Osgodby Town Council had raised concerns in relation to additional vehicles accessing the Fossards, and it was queried if steps had been taken to mitigate these concerns. · At paragraph 7.8 of the report, Yorkshire Water had recommended the inclusion of a condition related to surface water drainage. A query was raised regarding the nature of this condition and whether it had been addressed by Yorkshire Water. · It was queried whether measures had been taken to address the comments made by North Yorkshire Police regarding boundary treatments, visitor parking provision and bin locations. · It was noted that the developer was to provide a contribution of £65 per dwelling towards waste and recycling and it was queried if this amount would be sufficient to cover the provision of all four types of bins. · With regard to the Affordable Housing provision outlined in the officer update note, a query was raised as to whether this would be secured as a condition of the application to ensure the dwellings were designated for social rent. · If the applicant were to apply for and receive planning permission, permitted development rights would be removed, aside from this, it was queried whether there were any stronger measures the local authority could use to prohibit this occurring. · Members asked how strong an argument the Committee could make to ensure that social housing was secured within the S106 agreement and if a certain type of social housing could be requested. · Discussion took place regarding the affordable housing provision and Members expressed the view that there should be a fair proportion of 2, 3 and 4 bed housing types.
