Declarations of Interests All
Members are invited to declare at this point any interests, including the
nature of those interests, or lobbying in respect of any items appearing on
this agenda. Minutes: Councillor Cliff Lunn stated
that he was the Division Member for Hambleton and Thorpe Willoughby and
therefore had an interest in agenda item 6, however he had not expressed an
opinion on the application, maintained an open mind and would therefore be
taking part in the debate and decision. Councillor Mike Jordan
declared that he was a member of Sherburn in Elmet Town Council and as such had
an interest in item numbers 4, 7 and 8 of the agenda, as he had been heavily
involved in discussions on each application, he confirmed that he would be
leaving the meeting during consideration of each item. Councillor Arnold Warneken
advised that he had been lobbied on agenda item 4. Councillor Bob Packham
highlighted that he had been lobbied on agenda item 4 by local residents and
received a briefing note from the applicant.
He had also been present at meetings of Sherburn in Elmet Town Council
but had always made himself absent when planning issues were discussed,
therefore he had come to the meeting with an open mind, had not expressed any opinion
on the application and would be taking part in the debate and decision. He confirmed that he had also received an
email from the agent for agenda items 7 & 8. Councillors John Cattanach
and Karl Arthur stated that they had received communications by email on a
number of the applications on the agenda. The Chair confirmed that an
officer update note had been circulated and added to the North Yorkshire
Council website. Planning
Applications The Committee considered reports of the Assistant
Director Planning, Community Development Services relating to applications for
planning permission. During the meeting,
Officers referred to additional information and representations which had been
received. Except where an alternative condition was contained in
the report or an amendment made by the Committee, the condition as set out in
the report and the appropriate time limit conditions were to be attached in
accordance with the relevant provisions of Section 91 and 92 of the Town and
Country Planning Act 1990. In considering the reports of the Assistant Director
Planning, Community Development Services regard had been paid to the policies
of the relevant development plan, the National Planning Policy Framework and
all other material planning considerations.
Where the Committee refused planning permission the reasons for that
decision are as shown in the report or as set out below. Where the Committee granted planning permission in
accordance with the recommendation in a report this was because the proposal
was in accordance with the development plan the National Planning Policy
Framework or other material considerations as set out in the report unless
otherwise specified below. As per his earlier declaration, Councillor Mike Jordan
left the room for the consideration of item number 4. |

Report of the Assistant Director – Planning – Community
Development Services. Additional documents:
Minutes: The Assistant Director Planning, Community Development
Services sought determination of a
full application for the erection of 106 dwellings with associated works on
land to the south of Bartlett View and Rochester Row, Milford Road, Sherburn In
Elmet by Redrow Homes Ltd & Persimmon Homes Ltd (Yorkshire). A site visit
had been attended by Members on the morning of the Committee. The Principal
Planning Officer advised Members that there was an officer update note on the
application, and it was highlighted that comments had been received from
medical practices in Sherburn in Elmet and South Milford along with a
clarification from NHS Humber and North Yorkshire Integrated Care Board (ICB)
on their view on the comments from both practices, and re-confirmation that the
financial contribution that the ICB were seeking was the sum of £124,750. In terms of
Affordable Housing, there was clarification on the housing mix; updated plans
had been received from the applicant to ensure that all plans reflected the
latest version of the layout plan, and lastly, there had been some
consequential changes to some the conditions contained within the committee
report. John Irvin
spoke in objection to the application. Alex
Tant-Brown spoke on behalf of Sherburn in Elmet Town Council, objecting to the
application. Mark Johnson,
agent, spoke in support of the application. During
consideration of the above application, the Committee discussed the following issues:- · Members thanked the officer for the
update note which they had found useful, particularly in terms of the
healthcare update, and asked for clarification that it was the advice that the
ICB, as statutory consultee, had provided that Members must rely upon for the
S106 agreement. · In terms of the long term control of
the sales access, Members queried what mechanism were officers proposing that
would deal with the sales office access once it had ceased to be used for that
purpose, and would a timescale be applied. · The report stated that there would be
a modest scale of loss of agricultural land, and it was queried how many
applications the Council would need to receive for Members to have a concern
regarding the agricultural landscape and economy in the area. · It was queried why there was no
mention of a condition around electric vehicle charging points within the
application. Three
Members, having listened to the level of public objection on the grounds of
highways safety, stated that they still had considerable concerns regarding the
application in terms of the highway access to the site, and felt that the
application should be refused as the site access was not acceptable, and that
the access should be, as was originally intended, from Milford Road. Councillor
Cattanach proposed that the application be granted, Councillor Lunn seconded
the motion, however, the remaining 3 Members voted against, therefore the

2023/0097/OUTM - Land off Weeland Road, Hensall, Selby Report of the Assistant Director – Planning – Community
Development Services. Additional documents: Minutes: The Assistant Director Planning, Community Development Services sought determination of an outline planning application (all matters reserved except for partial means of access to, but not within the site) for the development of up to 24 dwellings at land off Weeland Road, Hensall, Selby. The Principal Planning Officer presented the application to Members and highlighted that there was an officer update on the application. A consultation response had been received from the Primary Care Trust which confirmed that there was no contribution necessary on the application and any reference would be removed from the draft Heads of Terms in section 10.115 of the report. Three additional letters of objection had been received; these mainly reiterated the objections which had already been raised and dealt with within the committee report, apart from a new concern raised over the ecological assessment provided as part of the application. The Council’s Ecologist had looked at the objection and noted that the issues had been covered in the committee report, and that a detailed enhancement would be considered when the housing numbers and layout were applied for. Councillor Robert Tams spoke on behalf of Hensall Parish Council, objecting to the application. Rachael Martin, agent, spoke in support of the application. During consideration of the above application, the Committee discussed the following issues:- · Councillor Jordan, as Ward Councillor, observed that the village had no local amenities such as shops or public houses, and queried if the site was outside development limits for the village. · Clarification was requested on the reason for refusal on the previous application made in 2017; had the refusal been based on policy SP2, on the basis that it was a site not within the development limits and was there a mention on the size of the development. · It was queried if the Council still had a 5 year housing land supply would the officer’s recommendation have been for refusal. Councillor Cattanach proposed, and Councillor Lunn seconded that the application be GRANTED. The decision That planning permission be GRANTED subject to the conditions listed at section 12 of the Committee report and the prior completion of a Section 106 agreement. Voting record A vote was taken, and the motion was carried with 5 votes for, and 1 abstention. |

ZG2023/1033/FULM - Land East And South Of Gateforth Court, Hambleton, North Yorkshire Report of the Assistant Director – Planning – Community

Minutes: The Assistant Director Planning, Community Development Services sought determination of a full major planning application for the erection of 62 residential dwellings, formation of roads, hard and soft landscaping and associated infrastructure at land east and south of Gateforth Court, Hambleton, North Yorkshire. The Principal Planning Officer informed Members that four additional letters of objection had been received by the Council since the agenda had been published, in response to these and due to a slight change to the layout of the site, the application had been re-advertised, the publicity for which expires on 29 April 2025. In addition,
Highways had requested three amendments; that an additional condition be added
to control street lighting on Gateforth Lane, that the applicant provide a
footpath along the southern side of the site access, to connect the site
frontage to the layby outside the cemetery, and were now seeking a S106
contribution of £1000 be added to fund a Traffic Regulation Order (TRO) for
double yellow lines on the north side of the site access. Councillor Maria Ferris spoke on behalf of Hambleton Parish Council, objecting to the application. The agent, Ellie Glover, spoke in support of the application. During consideration of the above application, the Committee discussed the following issues:- · Members queried if any consideration
had been given to the possible expansion of the graveyard. · In terms of the £50k contribution
allocated for improving local bus services, it was queried what the monies were
for and how it would be assessed. · The reason that the officer
recommendation was minded to grant. · Whether the self-build dwellings were
also affordable housing. · Clarification was sought on what the
energy supply to the site would be. · Whether the Biodiversity Net Gain
would be off site. · Clarification was sought on what the
draft allocation policy was. · Whether the density of 19.5 included
the attenuation pond. · Members queried if there was a basis
used by the Council to request a commuted sum. · In terms of open space provision, if
the applicant wanted the provision offsite, did officers look at where the
nearest site would be in proximity to the application site. Three of the
Members raised concerns in relation to overdevelopment of the village, no
enhancement of services and the impact on children’s safety, in particular on
the road outside the school. Councillor Cattanach proposed, and Councillor Packham seconded that the application be minded to grant. The decision That Members were MINDED TO GRANT planning permission
subject to the conditions detailed in Section 12 of the Committee report,
completion of a S106 agreement,
and determination of the application be delegated to officers at the end
of the publicity period, subject to no new issues being raised. Voting record A vote was taken with 3 votes for and 3 votes against, at which time the Chair used his
casting vote. The motion, minded to
grant the application was therefore carried. Councillor Jordan left the meeting at this point, and did not return. |

Additional documents: Minutes: The Assistant Director Planning, Community Development Services sought determination of a reserved matters application (appearance, landscaping, layout and scale) pursuant to outline planning permission reference 2018/0697/OUTM for the construction of an employment park up to 1.25 million sqft (117,000sqm) gross floor space (GIA) comprising B2, B8 and ancillary B1 uses (all matters reserved except for access) at the former airfield site off Lennerton Lane, Sherburn in Elmet. The Principal Planning Officer presented the application to
Members. Steve
Buckley, agent, spoke in support of the application. During
consideration of the above application, the Committee discussed the following
issues:- · Members had noted within the
Committee report at paragraph 10.20 that condition 14 of the outline planning
permission had stated that applications for the approval of the reserved
matters for any part of the site were required to include details to demonstrate
that the design specifications set out in the letter dated 19 September 2013
from Sherburn Aero Club Ltd to Iain Bath Planning had been taken into account
as part of the scheme proposals in the interests of aviation safety. The design specifications were then listed,
however some of the specific details were not included, although it did state
that an informative could be attached.
Members queried if an informative were to be attached to the application
would the applicant be required to submit the details to the planning authority
for approval for the reserved matters planning permission to comply with the
outline planning permission. Concerns
were raised around the specific submissions which had not been received for
some of the items, therefore Members felt it would be appropriate to attach a
condition to resolve the matter. The Solicitor advised that if the Members wished to proceed on that basis then the decision would be a minded to grant decision, subject to the conditions set out within the committee report and an additional condition to address the details of any design specifications that had not already been submitted, with the decision delegated to officers after finalising the additional condition. The Development Service Manager advised that as the outstanding design specifications were quite minor in nature, but as they hadn’t been achieved at the reserved matters stage, the best way forward would be to make the decision a minded to grant decision, then once the outstanding design specifications information had been received and were considered acceptable, the application could be approved by officers. Councillor Warneken proposed, and Councillor Cattanach seconded that the application be minded to grant with the decision delegated to officers. The decision That Members were minded to GRANT planning permission subject to the conditions detailed in section 12 of the committee report, and to delegate authority to officers to determine the application following receipt of any outstanding design specifications. Voting record A vote was taken and the motion was declared carried
