Councillor Malcolm Taylor declared a registerable interest in item 4 as he was the Executive Member for Highways and Transportation  and left the room during consideration of item 4.

 

With reference to item 5, for the purposes of transparency the Chair and Councillor Joy Andrews declared that they were members of the Vale of Pickering Internal Drainage Board and Councillor Alyson Baker advised that a member of her family worked for Yorkshire Water.

The Head of Development Management – Community Development Services sought determination of a listed building consent application for the reconstruction of an 11,400mm section of parapet demolished following a vehicle strike, which will require a mixture of original and new stone. Take down and rebuild using the original stone approximately 1,500mm of parapet wall making up the southern refuge. Take down and rebuild using the original stone approximately 3,900mm of parapet wall at the southern end of the eastern parapet. Repoint the parapet walls to each elevation where require on land at The Bridge, The Avenue, Nunnington.

 

This application was brought before Planning Committee as North Yorkshire Council was the applicant.

 

The Senior Planning Officer drew Members attention to the updated plans circulated at the meeting, which showed the correct positions of the proposed repairs.

 

The Officer’s presentation showed the location of the bridge, its proximity to Nunnington Hall (National Trust property) and the extent of the damage caused by the vehicle strike.

 

There was clear policy support for the preservation of this heritage asset and therefore it was considered that the principle of the application was acceptable within the requirements of the Ryedale Plan, the National Planning Policy Framework and the Planning Listed Buildings and Conservation Areas Act.

 

Historic England and the Council's Principal Building Conservation Officer were consulted and gave strong support for the repair and sought specific conditions, which required details and samples of all new stone, the works to be carried out by specialist stonemasons and a site meeting between the Building Conservation Officer and the stonemason be undertaken in advance of any works.

 

Councillor George Jabbour, Division Member, was unable to attend the meeting and a statement in support of the application was read on his behalf.

 

Mr Alex Gardner, Agent, spoke in support of the application.

 

The Chair proposed that, as this was a heritage asset and officers had confirmed that the repairs would be done sympathetically, Listed Building Consent be granted, seconded by Councillor Joy Andrews.

 

Decision

 

That Listed Building Consent be granted subject to the conditions listed in the officer report with the exception of an updated version of the approved plans condition to include the plans circulated at the meeting.

The Head of Development Management – Community Development Services sought determination of outline planning permission for the construction of up to 150 dwellings with all matters reserved save for access on land north of Whitby Road, Pickering.

 

The application was referred to the Area Planning Committee for determination, in accordance with paragraph 9.3(a)(vi) of the North Yorkshire Council Constitution. Matters excluded from the delegation include planning applications on which a Member of the Council has made material planning representations in writing to the Corporate Director of Community Development within the publicity period and in consultation with the Chair the Corporate Director of Community Development is satisfied that it has been demonstrated that it raises significant material planning issues for the application to be considered by Committee. The necessary representation was made by Councillor Goodrick.

 

The Principal Planning Officer drew Members’ attention to the updates recently issued to the Committee and a further comment received in relation to drainage matters.

 

Due to the Council’s current housing land supply position, the proposal falls to be considered under paragraph 11(d) of the National Planning Policy Framework, which establishes a presumption in favour of sustainable development unless adverse impacts would outweigh the benefits.

 

The scheme would deliver up to 150 dwellings and make a meaningful contribution to housing supply, including a policy-compliant affordable housing provision comprising a mix of affordable rented, social rented and intermediate homes. The development would not result in significant harm to the amenity of neighbouring properties, and appropriate standards could be secured through conditions.

 

The site was within Flood Zone 1 and was at low risk of flooding. Surface water drainage was proposed to connect to a surface water sewer, with the Lead Local Flood Authority raising no objection and identifying a preferred connection option. Although Yorkshire Water objected on the basis of limited capacity at the local treatment works, it was noted that statutory provisions require water companies to manage and upgrade infrastructure as necessary, and that planning should focus on land use acceptability. Appropriate safeguards would be secured through pre-commencement conditions and further details at reserved matters stage.

 

The Highway Authority had raised no objections and was satisfied that the local network could accommodate the additional traffic. Access arrangements were to be determined at this stage, with other matters reserved. Indicative proposals showed provision for pedestrian and cycle links, green infrastructure and a play area, with existing landscaping to be retained where possible and supplemented with additional planting. The site’s location was not considered to have a harmful impact on the nearby National Park.

 

Overall, it was concluded that, when assessed against the presumption in favour of sustainable development, the benefits of the scheme, particularly in delivering much-needed housing, outweighed the identified harms. Subject to a Section 106 agreement and a comprehensive set of planning conditions, officers recommended that outline planning permission be granted, with detailed matters to be addressed at the reserved matters stage.
