Application for the variation of Premises Licence Report of the Corporate Director – Environment. Additional documents:
Minutes: The Sub-Committee considered the following:
1. Details of the application. 2. The report from the Director of Environment including appendices A-H. 3. Supplementary documents provided by Objectors 2 and 4 (pages 49-54 of the report). 4. Supplementary information provided by the Applicant (pages 43-47 of the report). 5. The Licensing Act 2003 (as amended). 6. Guidance issued under Section 182 of the 2003 Act. 7. Relevant licensing objectives as detailed in the written report. 8. Statement of North Yorkshire Council’s licensing policy. 9. Written and oral representations from the Applicant. 10. Written and oral representations by local residents/objectors.
The Sub-Committee heard a presentation for the Area Licensing Manager. This was followed by questions from all present.
In support of the application, the Applicant made a verbal presentation. This addressed some of the issues raised by those objecting to the application. This was followed by questions from all present.
Representations from a number of objectors were heard again followed by questions from those present.
Resolved –
That the Sub-Committee considered all written and oral representations from all parties and taking into account all of the above, unanimously decided that it was appropriate and proportionate, having considered all of the representations, all the evidence presented to it, whilst also taking into account the Licensing Act 203, the Secretary of State Guidance issued under Section 182 of the Licensing Act 2003, North Yorkshire Council’s Statement of Licensing Policy, and the promotion of the licensing objectives to grant the licence variation as requested in the application, but with the addition of one further condition, that noise emanating from the premises should not penetrate the nearest noise sensitive property. |
