Exclusion of the press and public To consider passing a resolution under Section 100A(4) of
the Local Government Act 1972 excluding the press and public from the meeting during consideration of item 5 on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A to the Act. Minutes: Resolved – That under Section
100A(4) of the Local Government Act 1972, the press and public were excluded from
the meeting during consideration of the item of business on the grounds that it
involved the likely disclosure of exempt information as defined in paragraph 1
of Part 1 of Schedule 12A of the Act as the Panel was satisfied that the public
interest in maintaining the exemption outweighed the public interest in disclosing
the information. |

Application to Review a Personal Licence Minutes: The Sub-Committee considered the following: 1. The report from the Corporate Director of Environment which included appendices 1 – 7. 2. Oral representations made by the personal licence holder. 3. Oral submissions from the Licensing Authority. 4. The Licensing Act 2003 (as amended). 5. Guidance issued under Section 182 of the 2003 Act. 6. Relevant licensing objectives as detailed in the written report. 7. North Yorkshire Council’s Statement of Licensing Policy. 8. The form provided by the personal licence holder to the Sub-Committee at the commencement of the hearing. Cross questioning was undertaken following the presentations. The Sub-Committee carefully considered all matters that had been presented at the hearing, as well as all information available to them. The Sub-Committee was reminded by the legal advisor that they could not look behind the conviction the licence holder had and in relation to previous convictions, they were reminded that a licence holder’s convictions for a relevant offence must be disregarded if they are spent for the purposes of the Rehabilitation of Offenders Act 1974. The reasons provided by the Sub-Committee for their decision were set out in the Decision Notice provided to the licence holder. Resolved – To take no action. |
