The Sub-Committee considered the report of the Corporate Director of Environment in respect of an application for the grant of a Temporary Event Notice for Little Angel Inn, 18 Flowergate, Whitby, North Yorkshire, YO21 3BA. In addition to the report the Sub-Committee had sight of the Application, Premises Licence, evidence presented by NYC Environmental Health Service – Email correspondence, Noise Nuisance Investigation Report, Statement of Witness, copy Noise Abatement Notices, Extracts from the Noise App Case Report and submissions from the Applicant.


In respect of the Applicant the meeting was attended by Richard Nattriss. He was not accompanied by a representative.

 

In coming to its decision, the Sub-Committee have had due regard to the 4 Licensing Objectives, namely;

 

-The prevention of crime and disorder

-Public Safety

-Prevention of public nuisance

-The protection of children from harm

 

After hearing the issues today, it is the Licensing objective of the prevention of public nuisance which is relevant and consideration has been given to this today. In coming to its decision, the sub-committee has considered the application on its own merits and has also had due regard to the National Guidance issued under section 182 of the Licensing Act 2003 and former Scarborough Borough Council Licensing Policy which has been adopted by The North Yorkshire Council.

 

RESOLVED: To allow the proposed activities as set out in the Temporary Event Notice to go ahead.
