The Statutory Licensing Sub-Committee considered the report of the Corporate Director, which sought determination of an application for the granting of a premises licence for Curlew Gelato Lounge, 32 Belle Vue Street, Filey, YO14 9HY.

 

The Licensing Enforcement Officer introduced the report and drew Members attention to the key issues, including the proposed conditions, which sought to meet the licensing objectives.

 

The Officer confirmed that no concerns or objections had been raised by North Yorkshire Police or the Fire and Rescue Service and no objections had been received from the additional two neighbours referenced in the objection attached to the report.

 

The applicant’s agent presented photographs to illustrate their response to address the concerns raised in the objector’s submission with refence to parking, opening hours, noise concerns etc.

 

In addition, the agent provided clarification on many of the concerns raised by the objector, such as:

 

·        Operating hours

·        The reasons for the request for licensing hours of 10am – 11pm

·        The remaining works at the premises

·        No artificial lighting in the outside area

 

The applicant confirmed that they were happy to agree additional conditions to prevent the use of the outside area of the premises after 8pm and prevent any “bottling up” between the hours of 6pm and 9am.

 

The Licensing Enforcement Officer confirmed that they had been unable to speak in person to the objector. The objector had responded to emails but had not requested to attend the hearing.

 

Decision

 

That the licence be granted subject to the conditions listed in the report for the promotion of the licensing objectives and the two additional conditions proposed to the sub-committee by the applicant.
