16/22 – TO AGREE A PROCEDURE FOR THE HEARING: A procedure for the hearing had been circulated to all parties as part of the agenda papers. The procedure was agreed.

RESOLVED (UNANIMOUSLY):

 

That, in accordance with Section 100A(4) of the Local Government Act 1972, in view of the nature of the business to be transacted, the meeting be not open to the public during the discussion of Minute 18/22 as there will be a disclosure of exempt information as defined in Section 100I of the Act.

 

The exempt information in question relates to individuals, information which is likely to reveal the identity of an individual and the financial or business affairs of any particular person (including the authority holding that information) as defined in paragraphs 1, 2 and 3 of Schedule 12A to the Act.

18/22 – LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT

             1976 TOWN POLICE CLAUSES ACT 1847 - APPLICATION FOR A

              HACKNEY CARRIAGE DRIVERS LICENCE: The Food, Licensing and Occupational Safety Manager (FLOSM) submitted a written report to determine an application for a Hackney Carriage Drivers Licence. It was before the Panel to consider the FLOSM’s written report, the Harrogate Taxi and Private Hire Licensing Policy 2022 and the relevant legislation as outlined at paragraph 5 of the exempt report.

 

The FLOSM presented the report and asked the Panel to consider whether the applicant was a ‘fit and proper’ person for the purpose of holding a Hackney Carriage Drivers Licence. The Panel applied the test contained within the Department for Transport Statutory Taxi and Private Hire Vehicle Standards 2020 of whether they would allow a person for whom they cared to travel alone with the proposed licence holder at any time of day or night. The options available to the panel were outlined in paragraph 5.11 of the exempt report. The applicant was then invited to present their submission to the Panel. 

 

Members of the Taxi Licensing Panel then retired to consider the application.

 

RESOLVED:

 

To grant a Hackney Carriage Drivers Licence for a period of 6 months. Officers are required to refer any future breach of the Taxi Policy or law which is alleged to have been committed by the applicant which may occur within 6 months of this decision to the Licensing Sub-Committee.
