To consider a report of the Corporate Director of Environment.

The Sub-Committee considered a report of the Corporate Director – Environment, which sought determine of an application for the variation of an existing premises licence in respect of Zoo Bar, 219a High Street, Northallerton, DL7 8LW.
The Sub-Committee considered the representations of the parties both written and oral, written statement of the Applicant, video footage submitted by an objector, the Licensing Act 2003 as amended, the Council’s Statement of Licensing Policy and the guidance issued under Section 182 of the Licensing Act 2003.
As a preliminary issue, the Sub-Committee resolved to admit representations that had been received after the statutory deadline, and therefore considered the contents of the emails and video relating to the alleged incident on the 26 October 2024. Although all of the objectors were invited to attend the hearing, none attended in person.
The Sub-Committee acknowledged that it was required to consider the application in terms of any likely adverse effects resulting from the sale of alcohol and the provision of regulated entertainment. Concerns that could not be directly attributed to the provision of licensable activities would need to be addressed by the relevant authorities under primary legislation.
The Sub-Committee had consideration of the of the Licensing Objectives which may be considered by the sub-committee, being:
1. Crime and disorder
2. Public safety
3. Public nuisance; and
4. The protection of children from harm
And emphasised the equal importance attached to each of the Licensing Objectives.
The decision
The Sub-Committee considered all written and oral representations from all parties and taking into account all of the above, unanimously decided that it was appropriate and proportionate, having considered all of the representations, all the evidence presented to it, whilst also taking into account the Licensing Act 2003, the Secretary of State Guidance issued under section 182 of the Licensing Act 2003, North Yorkshire Council’s Statement of Licensing Policy, and the promotion of the licensing objectives to grant the licence variation as requested in the application.
The Sub-Committee resolved to grant the application with the conditions as described in the Decision Notice.
