Forthcoming Decisions

Contracts which underpin the Council’s current Everybody Benefits Framework expire on 30th November 2024. The authority is looking to re-procure a framework for the provision of employee benefit discounts with salary sacrifice schemes.
It is proposed that the tender is divided into 6 lots:
Lot 1: Employee discount platform
Lot 2: Green car scheme
Lot 3: Home technology scheme
Lot 4: Cycle to work scheme
Lot 5: Childcare voucher scheme
Lot 6: Health cash plan scheme
The decision to be taken relates to procurement of the overarching Framework which has a significant published contract value, with the spend through the framework higher than £500k when it comes to employee participation. This is an in/out spend resulting in the council saving on the participation rather than spending from existing budgets.

Decision regarding outcome of marketing exercise to procure a short term operator for Alpamare Waterpark. The Council wishes to seek an operator to operate the site for a period of one year with an ability for an extension for a further year. This will enable the site to open in the short term and provide relevant information for a longer term strategy. The report will provide an update to the Executive on the marketing activity.

To apprise on the financial out turn of the Civil Parking Enforcement surplus income following completion of the approved two year investment period 2022/23 and request approval for the use of the surplus over the next three year period.

Officers are recommending approval of the West Harrogate Infrastructure Delivery Strategy (WHIDS). It has been prepared in order establish the timing and delivery of the infrastructure to support the development sites in West Harrogate. This work will inform the section106 requirements aiding efficient determination of planning applications.
It includes estimated phasing, build-out trajectories and apportionment of costs. The strategy documents can be used as a tool for delivery of the developments and their associated infrastructure by relevant authorities, service providers and developers.
Officers are recommending an update to the current West Harrogate Parameters Plan (WHPP) Appendix A (approved in February 2022).

To approve the award of the contract(s) for the purchase, licensing, implementation and on-going maintenance of a new finance system.

To set out the rationale and methodology for the countywide strategic speed limit review and prioritisation of resultant schemes.

Following consultation with the public to present the final recommendations on the community governance reviews considering the creation of town councils for Harrogate and Scarborough

To approve the North Yorkshire Autism Strategy, considering feedback and refinements following the public consultation.

To seek approval to undertake a procurement exercise for the adaptation and refurbishment of the former Ings Community Primary School, Skipton to create satellite SEN provision for Brooklands Special School, Skipton. The works will allow the sixth form provision to be relocated from Craven College following notice to vacate.

This is a statutory stage in the preparation of a Neighbourhood Plan post Examination

Report is to set out a recommendation to agree the appended Decision statement (a statement which sets out the Council’s position on the Neighbourhood Plan) and agree that a referendum will be held.

Both the LPA and the Qualifying body agree with all of the Examiner’s recommendations and are in the process of modifying the plan to make it is capable to meet the basic conditions tests.

To consider and approve proposals for a programme of works to schools arising from a capital allocation received by the Council for the financial year 2024-25.

To review the current maximum Hackney Carriage fares set by the Council consequent to consultation and statutory public notice.

Seeking approval to award the contract to 'Fox (Owmby) Ltd.' is a crucial step following a thorough and successful open procurement process. This process encompasses two distinct packages: Package 1 involves upgrading unadopted roads to meet adoptable standards, ensuring their integration into the existing infrastructure, while Package 2 focuses on the essential task of ensuring the safety and security of these unadopted roads. This recommendation is a result of diligent evaluation and consideration, highlighting Fox (Owmby) Ltd. as the most suitable and capable contractor for the job.
Value of Package 1 is £ 582,043.99
Value of Package 2 is £ 905,539.01

The report will set out the basis of a grant offer made by DEFRA and to recommend the grant be accepted. The offer is a section 31 grant to be spent in the financial year 2024/25 on new burdens arising from the introduction of mandatory Biodiversity Net Gain (BNG) in Feb-Apr 2024.

The council has a statutory obligation towards BNG. This burdens grant is offered to all English Local Planning Authorities in 2024/25.

The York and North Yorkshire Combined Authority has made gainshare funding available for regeneration projects in York and North Yorkshire that are well developed and close to implementation. Options have been considered for implementing schemes in North Yorkshire that pragmatically fit the criteria and are well-developed, and priority schemes have been identified.
The decision is required to submit the scheme for the Scarborough Boat Lift and associated works for funding of £600,000.

The York and North Yorkshire Combined Authority has made gainshare funding available for regeneration projects in York and North Yorkshire that are well developed and close to implementation. Options have been considered for implementing schemes in North Yorkshire that pragmatically fit the criteria and are well-developed, and priority schemes have been identified.
The decision is required to submit the scheme for renovation and new façade for the Selby station building, to accompany the Transforming Cities Fund scheme, in partnership with Network Rail / Trans Pennine Express, for funding of £700,000.

North Yorkshire Music Service has been awarded a grant to deliver on the Governments National Plan for Music Education by the Dfe and Arts Council England. The Music Service will be the Lead Organisation in the newly formed Music Hub, working closely with the York Music Hub to deliver the National Plan across both regions.

To report the outcome of a consultation on a proposed new Home to School Travel Policy for North Yorkshire.

The report will set out a recommendation on whether to agree an appended Decision Statement. The Decision statement will set out the Council’s position on the Neighbourhood Plan in-light of the Examiner’s Report and whether the Plan can progress to referendum.
Based on consideration of a Fact-Checking Draft of the Examiner’s Report, both the local planning authority (LPA) and the qualifying body responsible for the preparation of the plan (Pannal and Burn Bridge Parish Council) agree with all of the Examiner’s modifications recommended as necessary for the Plan to meet the basic conditions. This will be confirmed on receipt of the final Examiner’s report.
Subject to a favourable decision, the Plan would be amended in-line with the recommended modifications post-decision and this modified Plan would go forward to referendum.

To seek permission to publish Statutory Proposals on a proposal that St Hilda’s Ampleforth Church of England Voluntary Controlled Primary School should close with effect from 31 August 2024.

Due to the variations in approach towards the method of delivery of the disabled facilities grant, there were also some subtle variations between the legacy areas in relation to their policy approach and their interpretation and implementation of legislation. Whilst all areas are using the powers and flexibilities given within the legislation, there has been some variation in terms of scope of works undertaken along with differences in financial thresholds and parameters adopted. The report will outline how the policy seeks to draw together an interpretation of the mandatory elements of Disabled Facilities Grant (DFG) legislation and the discretionary elements of the RRO into a single published document. The report will therefore sets out the key recommendations for the policy and seek agreement to adopt the North Yorkshire Housing Assistance and Disabled Facilities Grant Policy for the new authority. The new policy is to be adopted for all tenures, to provide a consistent approach to delivering adaptations for owners and tenants in the private sector and our own housing tenants.

Following the publication of statutory notices, to determine whether to change the age range at Boroughbridge High School, effective from 31 August 2024, by ceasing the Sixth Form Provision.

If there are no objections to the statutory notices, this decision will be taken by the Executive Member for Education, Learning and Skills at the meeting with the Corporate Director - Children and Young People’s Service

The purpose of the report is to set out the Council’s approach to voting in Business Improvement District (BID) ballots and re-ballots.

To ensure it is private businesses that determine the result of the ballot the Council intends to take a neutral position by abstaining from voting in BID ballots and re-ballots. This decision seeks to formally confirm this position.

To approve the ten year Long Term Plan for Scarborough and initial three year Investment Plan of agreed interventions to receive, allocate and spend funding received from Government through the Long Term Plan for Towns programme.

To feedback the results of a public consultation on outline proposals for improvements to Whitby harbourside public realm, including proposals to signalise the junction of Spital Bridge and A171 and decide on the next steps for the scheme.

To seek agreement on the finalised draft of the North Yorkshire parts of the proposed Key Route Network for York and North Yorkshire ahead of approval by the Mayoral Combined Authority.

Proposal to move to public consultation for a Public Space Protection Order (PSPO) in Scarborough.
The PSPO is intended to protect a public space from persistent or continuing anti-social behaviour, which is having a detrimental effect on the quality of life of those in the locality.

Procurement of additional Oracle financial licence for NYC.

To consider the proposed North Yorkshire Joint Health and Wellbeing Strategy and recommend it for adoption to the Council.
NOTE: The North Yorkshire Health and Wellbeing Board’s Terms of Reference state that “The Joint Health and Wellbeing Strategy will be referred to the Council for approval as part of the Council’s Policy Framework.”

To seek permission for acceptance of £1.5m grant funding from the Environment Agency (EA) to progress Phase 2 of the project. The grant will allow progression to completion of the project including the procurement of a specialist consultant to design and project manage the works and a contractor to undertake the works.

Phase 1 works was successfully completed in 2014 and in 2022 the former Scarborough Borough council applied for a grant from the EA to undertake Phase 2.

To seek approval from Full Council to adopt the Housing Strategy 2024 to 2029.

The purpose of this report is to enter into a Memorandum of Understanding (MOU) with the Department of Levelling-Up, Housing and Communities (DLUHC) for funding of £1,740,114 from the Local Authority Housing Fund (LAHF).
This funding will contribute towards the acquisition of 2 homes for temporary accommodation for homeless households plus an additional 11 affordable homes to provide accommodation for 11 households from the Afghan Citizens Resettlement Scheme (ACRS).

To approve the extension of the Mental Health Supported Housing contract and approve the inclusion of additional funding previously provided by Craven District Council into the main budget.

As a provider of adult education in receipt of grant funding of over £1m we must write and publish an accountability statement to form part 2 of our funding agreement with the Skills Funding Agency. We have also been advised that to meet financial procedure rules we must also document approval to receive the recurring grant funding that will make up part 1 of the documentation.

The statement is a mandatory part of the legislation linked to our current funding arrangements but must make clear reference to a document, written by West and North Yorkshire Chamber of commerce called the Learning Skills Improvement Plan (LSIP) and the key priorities of the council. This document is this year’s version of a document approved for 2023-24 and our response is largely based upon the strategy for adult learning and skills engagement that we consulted on in July 2022 and just defines targets based on the LSIP and national skills requirements

The decision is required to submit the scheme for works to accompany the Harrogate Station Gateway TCF scheme (signals and junction works and enhancements to Station Square) for funding of £500,000.

The report will set out the detail of the proposed NYC housing enforcement policy, which is required in order for us to deliver our statutory duties in relation to housing standards in the private sector.

Approval is required to hold an open procurement for a care market representative.

The purpose of this organisation is to support the care market in North Yorkshire ensuring that care providers are involved and informed across a whole range of quality, safety, finance, and business operating aspects. The organisation is required to engage and contribute to, local, operational and system wide discussions. The organisation is consulted on matters affecting the care market in North Yorkshire and represents the care market in negotiations around the annual inflationary uplift award.

A service agreement is in place ceasing on 30th September 2024. The new Care Market Representative contract will commence from the 1st October 2024.

The report details the background to the fees and charging policy, the supporting policy document demonstrating our statutory responsibility to provide a published policy that offers transparency on areas of provision that we make charge for.
