To seek authority for the variation of a Restrictive Covenant over land at Sherburn in Elmet to enable the landowner to progress proposals for the development of the land.

NYC benefits from an overage agreement and a restrictive covenant over the land. The variation of these agreements will provide a capital receipt for the Council.

Given the likely value of the capital receipt, a decision will need to be taken by NYC’s Executive.
