North Yorkshire Council must designate a
neighbourhood area if it receives a valid application and some or
all of the area has not yet been designated (Section 38A of the
Planning and Compulsory Purchase Act 2004).
Bishop Monkton Parish Council submitted an application to North
Yorkshire Council to designate the Parish Council area as a
Neighbourhood Area. As per the regulations, the Council is required
to designate the neighbourhood area without consultation as it
relates to the whole of a single parish.
